Judge Rules that Trump Appointed L.A.’s Top Federal Prosecutor Has Been ‘Unlawfully’ Serving
EXCERPT:
ROGERS: “Generally the way this works is a president appoints a U.S. attorney to a district, and then that attorney is approved by Congress. Well, that never happened in Bill Essayli's case. We'll show you some video of him. You know who he is. You've seen him on our air frequently. So what happened is that role generally has a 120-day window before that person either has to be approved by Congress or something else has to happen. The judge ruling today Essayli is unlawfully serving as a de facto United States attorney and is disqualified from participating in or supervising the prosecutions of Ramirez and Tran. Those are the two cases that challenged his authority essentially. Now, the defense attorney in those cases asked for the judge to dismiss them altogether. That's something the judge refused to do, but did acknowledge that Bill Essayli, as you heard there, is, quote, 'unlawfully holding his position.' Now, after he was the acting U.S. attorney for the Central District, he was then moved to a different position called first assistant U.S. attorney, and that is the role he currently holds. But the judge's ruling today says that essentially is the same thing, and he is unlawfully holding that position.”
