SWOYER: "I was a bit disappointed the way the prosecution cannot after this trial was officially declared. Sometimes you see a prosecutor or D.a. come out and say we are going to suggest we are coming in strong. They didn’t promise anything and they didn’t come as any sort of retrial but on the other hand you saw how passionate clancy’s attorney was. He declared victory and the sound bites they played. I was really bothered to be Frank about his of the one juror that was I guess the holdout in terms of going to the guilty side. Some of the statements he made ahead of this when he was identifying the juror as a male, I think that was a bit too far. I think there should be questioned questions immediately if there will be sanctioned out against the attorney for some of his remarks but in terms the prosecution they will have to decide what they do. 11-1 is a tough call.”
