But remember that that diagnosis is not a defense, it is whether or not that rendered you incapable of telling right from wrong. So where do we go from here, given the unfortunate split tilting towards the defense? It will be reviewed — you heard the day-to-day, they will regroup, they will talk about it, they will talk about the split and they will talk about what went right, what went wrong and how they can restrategize. You know a retrial is going to benefit the prosecution in this case, because you will notice the way that case really ended up warming up towards a fantastic ending — obviously not good enough.”
