U.S. Attorney Jeanine Pirro dropped the case after she said the Interior Department, Bret, withheld evidence that cleared Hern and pointed to the contractor as a reason for the pool problems. President Trump has repeatedly criticized Pirro for the decision, but she stands by it. FOX is told DoJ officials are looking at a potential misdemeanor charge today for Hern.
