HONIG: "Very important distinction there. Let’s think about the position that Jeanine Pirro is in right now, because she’s the one who’s going to have to make this thumbs up, thumbs down decision. She can’t avoid it. She’s got to go in yes or no. Jeanine Pirro is hanging by a string right now because of the fallout from the reflecting pool indictment. We all saw Donald Trump get in front of the cameras and say she, quote, folded like an umbrella. And then he had her into the White House where he lambasted her. He didn’t fire her. So now, given what we know about Jeanine Pirro’s history as a loyalist, given how close she came to getting fired for displeasing Trump a few days ago. What are the chances realistically that Jeanine Pirro says, 'You know, I’ve taken a hard look at this case and I’ve decided that it doesn’t merit prosecution and therefore I will exercise my prosecutorial discretion and give it a pass?' I think the chances of that are extraordinarily low. Now, as you can probably tell from my tone, I don’t think this case will ultimately succeed. I think Fauci had a valid Fifth Amendment invocation. But if you ask me what’s likely to happen in the real world, it wouldn’t shock me at all if he gets indicted."
