Rand Paul: ‘Why Would You Need the Fifth Amendment if All You Have To Do Is Come Before a Committee and Not Lie?’

PAUL: “You know, I’m doing everything I legally can. Even before all this, for the last four years, I’ve referred him twice criminally for charges to the DoJ under Biden, twice under Trump. Tomorrow, what will happen is if the committee votes for it, we will then forward that from the committee to the Department of Justice seeking the same. This time, though, contempt is different. You can be jailed for contempt or you can be told by a judge that you have to testify. So, if they can get this into the court, if they choose to pursue it, the judge will have a couple of choices. The judge could say, well, he’s allowed to plead the Fifth, or the judge could say, well, he’s been pardoned. Why would he need to plead the Fifth? And of what value his testimony if he doesn’t have to promise not to lie? I mean, why would you need the Fifth Amendment if all you have to do is come before committee and not lie? I mean, he can say that he destroyed records. He can say that he lied previously to Congress. He’s just not lying this time. But there still are remedies, but I can’t do it by myself. I have to have the help of the Department of Justice decide that this is something they wish to pursue.”
