PAUL: “So next week we will vote to hold him in contempt of Congress. That is a felony, and he can be prosecuted. We can't prosecute him, but we refer him to the Department of Justice. So there is a question, can you plead the Fifth Amendment when you've been pardoned? If you've already been granted immunity, how can you be seeking immunity from self-incrimination if you've already been granted immunity? So at the very end, I ask him the very specific question, within the parameters of your pardon, this is a question within the parameters of your pardon, did you destroy records? And he refused to answer that. So a court will have to decide. The Department of Justice has to be convinced to take the case, and then the court will have to decide, does his Fifth Amendment privilege apply when he has a pardon? This has been debated across the internet, across the country, and we're going to find out an answer.”
