Andrew Weissmann: Criminally Prosecuting Jack Smith Is ‘Preposterous,’ His Letter Concerning Phone Records Isn’t Perjury

WEISSMANN: “Because this is one of these instances where I know that usually we’re very careful to say, you know, it seems like or it appears, but this is one where there’s just no two ways about it that this is preposterous. And the easiest way to do that is to just tell you what is alleged. What is alleged is that Jack Smith lied. In response to the following question. He was asked, did you get the content of text messages from members of Congress through a search warrant? Did you get the content of text messages of members of Congress through a search warrant? To which he said, no, I didn’t. I only got telephone records through this other process. That is 100% truthful. The fact that Jack Smith also got documents from the national archives was not asked. He was in any way, shape or form. So this story is not just about the sort of retribution that we’ve seen from the Department of Justice. To me, this is the complicity of, in this case, Jim Jordan, who is the signatory of the letter with doing the referral. It on its face, it is not perjury, period. I mean, I’D love to. I usually am more careful to say, you know, it seems like or we don’t know everything they have. You cannot read this letter and in any way view this as perjury.“
