STELTER: “That‘s a really great question. A really great point. We are living through a period where we‘re going through First Amendment stress tests in the United States, and almost every time there‘s a test, we pass, the country passes. In this case, The New York Times viewed this as a test right away. And instead of having this happen in secret, the way many subpoena fights have taken place in secret, there was a case during the first Trump Administration where CNN was faced with one of these, and our lawyers were gagged. They weren‘t allowed to share it publicly, which was a really distressing situation at the time. CNN passed that test years ago. Other news outlets have passed those tests. And now, in this case, The New York Times fought really hard to make this public, to not let this be waged in secret. They made sure that they fought to make sure these records were unsealed in recent days.“
