McGHEE: "Well, the problem with the Supreme Court's decision is it sort of bars Congress from doing anything, because what John Roberts and Amy Coney Barrett decided to do is read into the 14th Amendment, a right to birthright citizenship, thereby barring Congress from necessarily legislating against it. However, the reason I’m not too concerned about this decision is because I just don’t think it's long for this world. Even though the justices wanted to depend on their originalist readings of legalese, it flies in the face of common sense. The idea that a communist in China can send over a surrogate here to have a child, it flies in the face of everything that Americans know and believe to be true. So you asked about the momentum, I think what will happen is this will become the new test for legal scholars on the conservative side, just like Roe was before. This will be the litmus point for a lot of new lawyers and judges who are looking to get involved in the conservative legal movement."
