SCHIRARD: “It really depends on what the initial reason for the police response to the house was. What intelligence was gleaned that led them to that house? And was at the house or was it the people inside it? Or was it a car? That is really where the questions lie. If this was possibly an arrest warrant, than they are looking for the people inside the house. And then they may get a search warrant down the road. If it is a search warrant for the residents, they are just clearing everybody from the house, and they can question them separately, go and search the house and then try to identify them and go down that trail as well. If it is for a piece of particular evidence like a car or a property on a smaller shack or property on that particular house, then it will be for that as well. So we don’t really know if they are looking for particular people on this piece of property, if they are there to serve a search warrant because something led them to this location, or if they are there looking for an object or an individual piece of evidence”
