Dave Aronberg: The Trump Admin Knew They Could Not Win on Birthright Citizenship, So Instead, They Focused on Nationwide Injunctions

ARONBERG: "Alex, Good to be with you. The Trump Administration engaged in some sort of gamesmanship here. They knew that they were not going to win on birthright citizenship. So instead, they focused their appeal on the issue of nationwide injunctions and the court delivered. And that’s going to help Trump when it comes to all of his his policies, because now it’s going to be so much harder to stop them. You need to really do a class action. Perhaps in certain cases filed by states, they could get those nationwide injunctions again, but it’s going to. So a lot of confusion when it comes to birthright citizenship, I still believe that that is solid. The Supreme Court didn’t take that up. And every court that’s decided that case of birthright citizenship has ruled emphatically against the administration, that the 14th Amendment says what it says. So I don’t think this ruling will directly impact that, because I think that line of cases, those that line of precedent is solid."
