and founder of ░░░░░░░░ up and up Rachel ░░░░░░░░ s a CNN senior ░░░░░░░░ analyst John Avlon former ░░░░░░░░ max rosen former federal ░░░░░░░░ k teachers haski as ░░░░░░░░ as CNN political commentator ░░░░░░░░ Soltis Anderson Good to ░░░░░░░░ all of you tonight ░░░░░░░░ Katie let s pick ░░░░░░░░ If we could there ░░░░░░░░ was really struck by ░░░░░░░░ just laid out so ░░░░░░░░ The comments in that ░░░░░░░░ from Justice Alito does ░░░░░░░░ tell you anything about ░░░░░░░░ it could look like ░░░░░░░░ and likely when this ░░░░░░░░ up back in front ░░░░░░░░ the justices well it ░░░░░░░░ a very interesting decision ░░░░░░░░ the court But it ░░░░░░░░ really not in my ░░░░░░░░ inconsistent with the way ░░░░░░░░ they ve looked at ░░░░░░░░ authority in the past ░░░░░░░░ as many people have ░░░░░░░░ out the Supreme Court ░░░░░░░░ specifically said that they ░░░░░░░░ defer to the FDA ░░░░░░░░ making decisions about when ░░░░░░░░ is approved and the ░░░░░░░░ under which it is ░░░░░░░░ So in many ways ░░░░░░░░ opinion is very consistent ░░░░░░░░ that history and it ░░░░░░░░ does how the Supreme ░░░░░░░░ to stay out of ░░░░░░░░ abortion business to a ░░░░░░░░ extent Like they said ░░░░░░░░ wanted to do when ░░░░░░░░ overturned Roe So in ░░░░░░░░ mind legally speaking the ░░░░░░░░ maybe it telegraphs what ░░░░░░░░ ll do when the ░░░░░░░░ comes up because it ░░░░░░░░ will come up once ░░░░░░░░ fifth circuit rules on ░░░░░░░░ but in terms of ░░░░░░░░ that decision might be ░░░░░░░░ mean the court has ░░░░░░░░ that they do differ ░░░░░░░░ the agency s just ░░░░░░░░ on these medical matters ░░░░░░░░ I m optimistic in ░░░░░░░░ sense You feel it ░░░░░░░░ stay that way Max ░░░░░░░░ there any concern there ░░░░░░░░ been you know we ░░░░░░░░ talking last hour about ░░░░░░░░ the way we ve ░░░░░░░░ the democratic messaging ramp ░░░░░░░░ Certainly in the wake ░░░░░░░░ jobs but really just ░░░░░░░░ the last couple of ░░░░░░░░ Mustard that messaging led ░░░░░░░░ vice president Harris who ░░░░░░░░ really been put out ░░░░░░░░ you know as a ░░░░░░░░ on this topic absolutely ░░░░░░░░ it s a winning ░░░░░░░░ for the Democratic Party ░░░░░░░░ is very clear that ░░░░░░░░ amidst economic trends that ░░░░░░░░ against the party and ░░░░░░░░ with President Biden not ░░░░░░░░ having the most ideal ░░░░░░░░ numbers so long as ░░░░░░░░ m glad you find ░░░░░░░░ funny so long as ░░░░░░░░ issue is at the ░░░░░░░░ Democrats believe that they ░░░░░░░░ a fighting chance in ░░░░░░░░ But what is shocking ░░░░░░░░ all of this because ░░░░░░░░ s very clear fact ░░░░░░░░ I just said It ░░░░░░░░ the fact that the ░░░░░░░░ Party continues to talk ░░░░░░░░ this issue and continues ░░░░░░░░ push extremist policies particularly ░░░░░░░░ the state level I ░░░░░░░░ that is because their ░░░░░░░░ is actually massively different ░░░░░░░░ the majority of voters ░░░░░░░░ that fact and that ░░░░░░░░ alone maybe why the ░░░░░░░░ Party is on the ░░░░░░░░ towards much more of ░░░░░░░░ permanent minority status I ░░░░░░░░ you d love to ░░░░░░░░ to that because I ░░░░░░░░ you re also looking ░░░░░░░░ this is breathing a ░░░░░░░░ bit of a sigh ░░░░░░░░ relief tonight Well for ░░░░░░░░ Republicans they are not ░░░░░░░░ in the Supreme Court ░░░░░░░░ viewed as a political ░░░░░░░░ as a political entity ░░░░░░░░ an arm of the ░░░░░░░░ Party The Supreme Court ░░░░░░░░ t want to be ░░░░░░░░ that way And so ░░░░░░░░ ruling is pretty consistent ░░░░░░░░ that with the sort ░░░░░░░░ depoliticizing of the court ░░░░░░░░ saying let s just ░░░░░░░░ the process play out ░░░░░░░░ s preserve the status ░░░░░░░░ for now and see ░░░░░░░░ this goes um when ░░░░░░░░ comes to the politics ░░░░░░░░ this issue the challenge ░░░░░░░░ Republicans have been faced ░░░░░░░░ is that prior to ░░░░░░░░ overturning of Roe versus ░░░░░░░░ if you asked Americans ░░░░░░░░ instance since Do you ░░░░░░░░ that abortion is morally ░░░░░░░░ or unacceptable An awful ░░░░░░░░ of Americans say they ░░░░░░░░ not really comfortable with ░░░░░░░░ They don t like ░░░░░░░░ They don t celebrate ░░░░░░░░ but at the same ░░░░░░░░ would say but let ░░░░░░░░ allow row versus Wade ░░░░░░░░ stand the falling of ░░░░░░░░ Put that as the ░░░░░░░░ questions so when somebody ░░░░░░░░ thinking about my pro ░░░░░░░░ or pro choice that ░░░░░░░░ of do I like ░░░░░░░░ or not Do you ░░░░░░░░ it s ok is ░░░░░░░░ central to how they ░░░░░░░░ thinking about that question ░░░░░░░░ they re thinking what ░░░░░░░░ I think about the ░░░░░░░░ of Roe versus raid ░░░░░░░░ these limits that may ░░░░░░░░ going further than they ░░░░░░░░ comfortable with on abortion ░░░░░░░░ their states That s ░░░░░░░░ the politics of this ░░░░░░░░ changed so dramatically and ░░░░░░░░ Republicans at the ballot ░░░░░░░░ Rachel when you look ░░░░░░░░ this right so you ░░░░░░░░ talking to young people ░░░░░░░░ you re reporting on ░░░░░░░░ these things What are ░░░░░░░░ missing from the conversation ░░░░░░░░ we talk about what ░░░░░░░░ conversation is right now ░░░░░░░░ is it among people ░░░░░░░░ age You asking that ░░░░░░░░ I think you know ░░░░░░░░ women The young woman ░░░░░░░░ speak with their really ░░░░░░░░ because they don t ░░░░░░░░ with with whether this ░░░░░░░░ going to be the ░░░░░░░░ thing or the next ░░░░░░░░ that s going to ░░░░░░░░ And so this is ░░░░░░░░ first generation in 50 ░░░░░░░░ that s growing up ░░░░░░░░ the federally protected right ░░░░░░░░ an abortion and for ░░░░░░░░ especially on college campuses ░░░░░░░░ s really daunting when ░░░░░░░░ re grappling with what ░░░░░░░░ means for on campus ░░░░░░░░ life These are day ░░░░░░░░ day Decisions that young ░░░░░░░░ in states for abortion ░░░░░░░░ has been banned or ░░░░░░░░ about You know what ░░░░░░░░ they re doing with ░░░░░░░░ bodies and what is ░░░░░░░░ they re comfortable doing ░░░░░░░░ that s now a ░░░░░░░░ that isn t necessarily ░░░░░░░░ their own hands because ░░░░░░░░ have stepped in and ░░░░░░░░ that you know should ░░░░░░░░ should you have an ░░░░░░░░ pregnancy or unwanted pregnancy ░░░░░░░░ that decision is not ░░░░░░░░ to be up to ░░░░░░░░ So I think you ░░░░░░░░ you really have to ░░░░░░░░ about on the day ░░░░░░░░ day what this means ░░░░░░░░ young people s lives ░░░░░░░░ the way that they ░░░░░░░░ interact with their peers ░░░░░░░░ in in it It ░░░░░░░░ just very different than ░░░░░░░░ way our parents grew ░░░░░░░░ And John is you ░░░░░░░░ looking at this in ░░░░░░░░ in the broader scope ░░░░░░░░ talked about how important ░░░░░░░░ is going to be ░░░░░░░░ into 2024 We saw ░░░░░░░░ important was in 2022 ░░░░░░░░ are you watching for ░░░░░░░░ it comes to these ░░░░░░░░ I m always want ░░░░░░░░ pay attention What independence ░░░░░░░░ moderates are doing But ░░░░░░░░ think you know max ░░░░░░░░ on this This is ░░░░░░░░ issue where um you ░░░░░░░░ the super majority of ░░░░░░░░ had a broad if ░░░░░░░░ consensus right that clinic ░░░░░░░░ in formation of safe ░░░░░░░░ and rare You had ░░░░░░░░ 15 of Americans wanted ░░░░░░░░ constitutional ban on abortion ░░░░░░░░ there said there shouldn ░░░░░░░░ be any restrictions But ░░░░░░░░ folks were in the ░░░░░░░░ overturning Roe That unprecedented ░░░░░░░░ all of a sudden ░░░░░░░░ Republicans they look like ░░░░░░░░ party that is about ░░░░░░░░ government They look like ░░░░░░░░ party That s uh ░░░░░░░░ to individual freedom or ░░░░░░░░ least self determination within ░░░░░░░░ these are the common ░░░░░░░░ structures that people had ░░░░░░░░ so I m fascinated ░░░░░░░░ are preoccupied by you ░░░░░░░░ they got this generational ░░░░░░░░ something that activists have ░░░░░░░░ pushing for within their ░░░░░░░░ without public support And ░░░░░░░░ a lot of them ░░░░░░░░ afraid to talk about ░░░░░░░░ They don t want ░░░░░░░░ because they think it ░░░░░░░░ bad politically while other ░░░░░░░░ that party wanted even ░░░░░░░░ maximalist position which they ░░░░░░░░ was ever their case ░░░░░░░░ they were trying to ░░░░░░░░ Roe DeSantis I wonder ░░░░░░░░ Katie As you look ░░░░░░░░ all of this even ░░░░░░░░ a legal perspective is ░░░░░░░░ a more fulsome discussion ░░░░░░░░ we are now almost ░░░░░░░░ year after jobs about ░░░░░░░░ and when women actually ░░░░░░░░ abortions even when it ░░░░░░░░ to medford kristen right ░░░░░░░░ ve talked so much ░░░░░░░░ it What s important ░░░░░░░░ note too is that ░░░░░░░░ is used in miscarriages ░░░░░░░░ when a woman miss ░░░░░░░░ her body cannot always ░░░░░░░░ what needs to happen ░░░░░░░░ so this medication actually ░░░░░░░░ it easier for a ░░░░░░░░ Sure the realities of ░░░░░░░░ it means and why ░░░░░░░░ woman and perhaps along ░░░░░░░░ her partner and or ░░░░░░░░ even her you know ░░░░░░░░ if she s a ░░░░░░░░ of faith than than ░░░░░░░░ faith leader why they ░░░░░░░░ these decisions has that ░░░░░░░░ changed Well I think ░░░░░░░░ strikes me the most ░░░░░░░░ this ruling from the ░░░░░░░░ is really what it ░░░░░░░░ to put the FDA ░░░░░░░░ complete control in my ░░░░░░░░ over the approval and ░░░░░░░░ dissemination of these drugs ░░░░░░░░ any level because at ░░░░░░░░ end of the day ░░░░░░░░ court really did mean ░░░░░░░░ they did not want ░░░░░░░░ be involved in the ░░░░░░░░ business And by this ░░░░░░░░ in my mind the ░░░░░░░░ is a political entity ░░░░░░░░ so the volatility of ░░░░░░░░ issue is not going ░░░░░░░░ change It s going ░░░░░░░░ keep going back and ░░░░░░░░ At extreme levels and ░░░░░░░░ Supreme Court just does ░░░░░░░░ want to be involved ░░░░░░░░ it And really if ░░░░░░░░ s going to be ░░░░░░░░ challenge to an action ░░░░░░░░ a federal agency the ░░░░░░░░ cannot get involved unless ░░░░░░░░ s shown to be ░░░░░░░░ and compressions and so ░░░░░░░░ they interpret the fifth ░░░░░░░░ s ruling in that ░░░░░░░░ is really going to ░░░░░░░░ the big question here ░░░░░░░░ ultimately they can differ ░░░░░░░░ and say we defer ░░░░░░░░ the federal agency and ░░░░░░░░ administration is in power ░░░░░░░░ that point might dictate ░░░░░░░░ that federal agencies decisions ░░░░░░░░ are so it really ░░░░░░░░ quite significant what the ░░░░░░░░ has done here in ░░░░░░░░ mind in putting the ░░░░░░░░ really back into the ░░░░░░░░ process and outside of ░░░░░░░░ court s hands in ░░░░░░░░ regards can the court ░░░░░░░░ a political at this ░░░░░░░░ Is there anything about ░░░░░░░░ courts that are a ░░░░░░░░ no Courts courts have ░░░░░░░░ been political I mean ░░░░░░░░ me They ve always ░░░░░░░░ political But I do ░░░░░░░░ that what we re ░░░░░░░░ with the current Supreme ░░░░░░░░ is Chief Justice Roberts ░░░░░░░░ an attempt to show ░░░░░░░░ they are above the ░░░░░░░░ and we ve seen ░░░░░░░░ as the trend ever ░░░░░░░░ they made their ruling ░░░░░░░░ ObamaCare now what the ░░░░░░░░ was from his perspective ░░░░░░░░ the Dobbs decision Was ░░░░░░░░ that really tilted in ░░░░░░░░ other direction and I ░░░░░░░░ now we re seeing ░░░░░░░░ consistent effort to try ░░░░░░░░ make some attempt to ░░░░░░░░ it back in that ░░░░░░░░ that you just said ░░░░░░░░ the issue of abortion ░░░░░░░░ the issue of rights ░░░░░░░░ this country and the ░░░░░░░░ of a woman s ░░░░░░░░ to make her own ░░░░░░░░ care decisions will remain ░░░░░░░░ most poignant and significant ░░░░░░░░ issue I believe for ░░░░░░░░ to come kristen we ░░░░░░░░ you know you were ░░░░░░░░ in our last hour ░░░░░░░░ Republicans have been caught ░░░░░░░░ footed when they re ░░░░░░░░ specific questions over the ░░░░░░░░ several weeks about abortion ░░░░░░░░ know Tim Scott is ░░░░░░░░ one of those What ░░░░░░░░ this change in terms ░░░░░░░░ messaging if anything in ░░░░░░░░ of a united message ░░░░░░░░ Republicans A lot of ░░░░░░░░ for a long time ░░░░░░░░ re able to say ░░░░░░░░ I believe that life ░░░░░░░░ prior to win abortionist ░░░░░░░░ allowed I think that ░░░░░░░░ versus Rick Wade is ░░░░░░░░ a poorly decided decision ░░░░░░░░ it is the law ░░░░░░░░ the land and so ░░░░░░░░ ll do what we ░░░░░░░░ to protect life by ░░░░░░░░ you know creating creating ░░░░░░░░ situation where there are ░░░░░░░░ abortions for other reasons ░░░░░░░░ there you know we ░░░░░░░░ offer We create a ░░░░░░░░ that celebrates life and ░░░░░░░░ people to celebrate parenthood ░░░░░░░░ is now gone And ░░░░░░░░ you can no longer ░░░░░░░░ well I m just ░░░░░░░░ to defer to row ░░░░░░░░ don t like it ░░░░░░░░ it s there Now ░░░░░░░░ is on the playing ░░░░░░░░ And so you had ░░░░░░░░ instance somebody like Ron ░░░░░░░░ Who could say hey ░░░░░░░░ ran in Florida on ░░░░░░░░ 15 week abortion ban ░░░░░░░░ I didn t get ░░░░░░░░ for it Actually you ░░░░░░░░ pass a law like ░░░░░░░░ and it s fine ░░░░░░░░ there s a very ░░░░░░░░ conversation When you re ░░░░░░░░ about a six week ░░░░░░░░ It s a really ░░░░░░░░ to put that to ░░░░░░░░ both in a general ░░░░░░░░ context and in a ░░░░░░░░ primary is that actually ░░░░░░░░ a majority of Republicans ░░░░░░░░ their part Ready to ░░░░░░░░ We will be watching ░░░░░░░░ right Just ahead here ░░░░░░░░ to the 10 commandments ░░░░░░░░ in public school classrooms ░░░░░░░░ controlled Texas Senate has ░░░░░░░░ a bill that would ░░░░░░░░ public schools public schools ░░░░░░░░ display the 10 commandments ░░░░░░░░ every classroom in a ░░░░░░░░ place What about separation ░░░░░░░░ church and state does ░░░░░░░░ still
