EISEN: “So we were fighting for a larger principle. We hammered starting the day after his arraignment, using the government’s own evidence that the pool was unchanged before and after he touched it, will use their own pictures. We filed more than seven motions. Finally, we forced the U.S. Attorney’s office to say this was the result of a botched, rushed installation, not David Hearn. We’re dropping the case, but they didn’t want to drop it with prejudice. They wanted to reserve the right to charge him again, because in this administration, the process is the punishment.“
