PATRICK: "I think we will go back to trial. The reason I say that is because when we think about the fact pattern, the fact pattern is uncontroverted, it is uncontested. That fact pattern is that Lindsey clancy, an emergency room labor delivery nurse whose job it was to bring life into the world, to bring children into the world, killed all three of her own. That is not in dispute, that right away takes us out of the realm of most types of cases we see. The only legal issue for that jury was not whether she did it, but whether at the time she was within the throes of a postpartum psychotic break, such that she didn’t understand right from wrong. And in Massachusetts, it is the prosecutor’s burden to prove that she had that capacity."
