Jonathan Turley Unloads on the Clancy Defense’s Attempt to Appeal the Judge’s Mistrial Declaration

TURLEY: "I just can't imagine how you're even going to articulate a theory like that. And you've got to be real darn careful because that's bordering, in my view, on the frivolous. And so I don't know what the heck he's going to file in front of that appellate judge, but I expect it's going to have a half-life measured in seconds. Now, once you get a mistrial, the prosecutors don't have to immediately arraign. They could talk about this. Look, putting aside the defense efforts here, they still miss by a large margin. I mean, if this is an 11-1 decision against them, the question they have to ask is, do we really think we can get 12 people without a single juror that does not have reasonable doubt as to who possibly lost this 11-1? The answer is that most prosecutors would say, let's do it again, particularly a team that really brought together the case in the summation."

TURLEY: "When I was listening to the summation, I was like, where the heck was that during the trial?"
