ROTUNNO: “I’D really be surprised, Charlie. And thank you for having me. But I’D really be surprised if the judge does not sentence him to life. Let’s remember, this judge was forced to be in a position where she had to rule on the most serious count here that carried the death penalty, and she had to throw that out. She said it was a pained decision that the law did not allow for stalking to be considered a violent crime, which of course seems crazy, right? Because what happens when you stalk somebody? Violence. But she talked about the statue. But but that the underlying thing had to be a violent act in and of itself, which is why she ruled that way. In order for you to have a federal murder charge, there has to be an underlying crime, because murder itself is not a statute in the federal system. Murder is a state charge. Unless there’s an underlying predicate issue that rises to the level of a case that they can try and then give you the death penalty. So the judge said she was pained. So I do”
