GOWDY: "I’d love to tell you it does, Bill, but I don’t think the Constitution requires that the pardon be in writing, just like it doesn’t require that a president declassify information in writing. The pardon powers are plenary. So if the president says, 'I’m pardoning you,' there doesn’t necessarily have to be a record. It’s good that there is, but there doesn’t constitutionally have to be one. I do get Rand’s point. Rand's point is, let’s go to litigate this, let's litigate the legitimacy of these pardons. But, look, a court is gonna say, there’s no requirement that it be in writing. Now, there is a requirement that Biden do it himself, so that is fair game to find out. But why not call Biden?"
