Harry Litman: Arresting Judges over Deportation Dispute Is ‘Unprecedented,’ ‘Beyond the Pale’

LITMAN: "Well, what he's saying to America is, 'We want to get rid of everybody, but we don’t want to give due process,' exactly what the Supreme Court has said must be given. We’ve known in this country there’s problems and clogs in the immigration system. Everyone understands that you need many more judges. That was part of the solution that Trump directed the Republicans not to act on when he was a candidate because he wanted to run on it. But it’s transparent in what he’s saying: We just gotta get rid of 'em and can’t have trials. No, I’m sorry. That’s not how the Constitution works. So, that is what he’s saying. In terms of the state court judges. Alex, what happened to Judge Dugan in Wisconsin really is unprecedented. The facts are tenuous and I believe will not hold up. But beyond that, going in, arresting a sitting judge and then grandstanding, as the attorney general did, as the head of the FBI did, is clearly beyond the pale of regular practice, just looking to make an example. I think this case is going to collapse in front of them."
