Greenberg: There’s a Number of Issues Raised in the Complaint Against Judge Dugan, She Did Things She Shouldn’t Have Done

‘She told them that he didn’t have an effective warrant to conduct an arrest, that was also wrong’

GREENBERG: "Well I will. Say that. Law enforcement here just going based. Off of what is. In the. Criminal complaint and assuming that that that is accurate for these purposes, they notified the court. Personnel of their presence. And plan. They stated. Their intention. To arrest. This man. After the court proceeding was. Done in a. Public hallway. That’s a. public space. In my experience as a prosecutor under. The Obama Administration, Trump Administration and Biden Administration, arrests could take place if criminal defendants. In the courthouse in public spaces. That’s because they’re not armed where. They’re in. Those spaces, and it’s for officer safety. And I think that there are a number of issues that were raised by this complaint, where judge dugan really did things that she shouldn’t have done. She was told. She told one of the. Law enforcement agents who. Was. In. A public space that she needed. To leave. The courthouse. There wasn’t. An. Authority to do that. She told them that he. Didn’t have. An effective warrant. To conduct. An arrest. That was also wrong. He did. She ordered the. Agents to go to. A chief. Judge’s office. While they were there. She then adjourned the criminal. Case that was before her, despite the fact that all the parties. Were there. Including victims that were there. Why did she do that? It seems clear she. Was notified. At that. Point of the fact that this arrest was going to happen. And she appeared to be unhappy about it. She also. Then ordered them to leave the courtroom through a jury door. That is not normal. That is not a thing that that that happens. To go into a nonpublic area. And then when she thought those individuals, the. Agents who. Were going to conduct the arrest. Were with the chief judge. She told them that they could. That he and his lawyer could leave the courthouse. So hard to see how she wasn’t taking specific actions to. Help this. Man evade arrest. And that is wrong. That said. So I would. I would not. Have gone forward and charged her with a crime. To me, this is the. Kind of. Thing where you could talk to her. You could have the judge. Talk. To her and. Scold her even and tell. Her. If you’re Then but you know. Yourself being charged."
