SCHOEN: “Justice Alito’s opinion was very strong in that case. I may be naïve still, I think when there’s a full review of these issues, I think the court will do the right thing. I think the court won’t stand for these ideas that we’re seeing coming out of some of the district courts. Listen, I have some confidence, also looking back at decisions, I look at five judges on the Fifth Circuit who have found non-justiciable these questions of the deportability and so on. I think there are also other mechanisms besides the Alien Enemies Act. These people will be deportable, period, from Mahmoud Khalil to Tren De Aragua and so on. President Trump will win this battle, it’s a question of where and when.”
