MCQUADE: "There’s no evidence that she did not genuinely believe that these were the results of her poll. You have to show that she knew that she was lying and that she was somehow doing this in an effort to harm his results in the election so that is one problem with it. But if you look at the law itself, it is designed to protect consumers from false claims and advertising about a product or solicitations for donations. This has nothing to do with either of those things. For that reason, this lawsuit will fail. But again, it is all about a warning shot to his critics and would-be critics."
