Fox News: Court Dismisses Daniel Penny Manslaughter Charge

MACCALLUM: “Daniel Penny is walking out of the courthouse in lower Manhattan. There he is. This young man, former Marine, still has this issue very much hanging over his head as he leaves there tonight. The larger manslaughter charge has been dropped, but the secondary charge of negligent homicide will now be on the table for these jurors when they go back to work come Monday morning. And this is a very difficult situation. A lot of legal minds weighing in this afternoon that Alvin Bragg, the DA in New York, specifically added this negligence charge in order for this circumstance, so that if they couldn’t reach a decision or found him not guilty on count one, that they would have the option to find him guilty of negligence. Andy McCarthy talked about the definition of that and how difficult, and in his opinion, inappropriate it is in this situation. But Daniel Penny has left the courthouse.”
