ATKINS: "That is in the hands of Congress. The ethics code that covers the Supreme Court, unlike other federal judges, it holds that the Supreme Court justices themselves decide if there has been a violation of that code. It’s the honor system, and we have seen the justices being very unwilling, at least, some of them. They have been very unwilling to adhere to that honor code. Congress can make it mandatory. They can do something like create some sort of independent outfit within the judiciary that decides, no, you must recuse in these cases, or you must return the value of what was given to you, but until Congress acts, this is where we are."
