MARIOTTI: “You know, you used the word, Katie, ‘wily.’ That is not a word we usually associate with Judge Cannon. We just heard from Ty Cobb, she’s incompetent, she sometimes makes these ham-handed decisions. This was, I agree, wily. And what is wily about it? She didn’t make a decision about things that would otherwise be cause for an appeal. So she basically put a situation in front of Jack Smith where she’s basically telling him you have nothing to appeal because I haven’t made a decision yet about the Presidential Records Act. I haven’t made a decision yet about exactly what the law is going to be in front of the jury, what the jury instructions are going to look like. I’m going to really take my time to consider that. I might wait until the trial starts when it’s too late for your appeal. When you can’t appeal if, for example, Donald Trump is found not guilty. Very wily.”
