KUPEC URBAHN: “I’m not sure the justices are even going to reach the merits of this case. They seem pretty skeptical that these doctors had standing to sue in the first place. These doctors are saying that, look, we have conscious objections, these women’s are taking these pills and then we inadvertently become complicit in finishing their abortion process and that’s against our beliefs. The justices seem skeptical of that argument. But I — one thing that did come up in the argument that I thought was interesting, and I don’t think they’re going to reach this in the decision, but it’s the heart of the merit which is okay, well who holds the FDA accountable at the end of the say? If there’s a high-risk drug, and this drug has appeared to be high-risk in different ways over the years, for instance, their own warning label says that one in 25 women who use it end up in the emergency room, and that strikes me as high risk.”
