Judge Nap: If Bob Menendez Is Convicted, Much of His Conviction Will Be Overturned
EXCERPT:
EARHARDT: "So Senator Menendez, he says I was just helping my friend. His friend's down in Florida, he was helping him with some medical disputes -- this guys is a doctor, in exchange for hotel rooms, in exchange for $750,000 in contributions toward his campaign. His excuses or his reason is that was my friend. That friend has already been convicted in MediCare overbilling cases. Do you think that Senator Menendez is going to get off scot-free or you think he's going to be convicted?"
NAPOLITANO: "I -- I don’t know, but I do believe that if he is convicted, much of the conviction will be overturned, Ainsley, because that phrase just helping my friend was used by the Supreme Court of the United States when unanimously overturned the bribery conviction of former Virginia Governor Bob McDonald saying, if the politician is just helping his friend, if there is no quid pro quo, if there is no I’ll do this for you if you line my pockets, well, that’s what politicians do and it’s not bribery."
