Tur We have breaking ░░░░░░░░ from the federal courts ░░░░░░░░ judge just ordered the ░░░░░░░░ Administration to release Mahmoud ░░░░░░░░ on bail The ruling ░░░░░░░░ end a three month ░░░░░░░░ for the former Columbia ░░░░░░░░ grad student Khalil is ░░░░░░░░ legal permanent U S ░░░░░░░░ and a new father ░░░░░░░░ played a leading role ░░░░░░░░ anti Gaza war demonstrations ░░░░░░░░ the Columbia campus last ░░░░░░░░ Joining us now MSNBC ░░░░░░░░ correspondent Lisa Rubin and ░░░░░░░░ News senior homeland security ░░░░░░░░ Julia Ainsley So Lisa ░░░░░░░░ me a little bit ░░░░░░░░ about this ruling What ░░░░░░░░ it mean for Khalil ░░░░░░░░ So first of all ░░░░░░░░ is an order that ░░░░░░░░ has to be released ░░░░░░░░ the judge s discretion ░░░░░░░░ we will obviously keep ░░░░░░░░ posted as to when ░░░░░░░░ if he is released ░░░░░░░░ or if the government ░░░░░░░░ a stay of this ░░░░░░░░ and immediately appeals it ░░░░░░░░ Katy in the meantime ░░░░░░░░ judge Michael Farbiarz of ░░░░░░░░ District of New Jersey ░░░░░░░░ granted an injunction to ░░░░░░░░ last week finding that ░░░░░░░░ primary reason that the ░░░░░░░░ wanted him kept in ░░░░░░░░ was not a legal ░░░░░░░░ valid reason that Khalil ░░░░░░░░ likely to succeed on ░░░░░░░░ That was what we ░░░░░░░░ the foreign affairs exception ░░░░░░░░ the Secretary of State ░░░░░░░░ allowed to say that ░░░░░░░░ finds that a particular ░░░░░░░░ poses a danger to ░░░░░░░░ United States conduct of ░░░░░░░░ affairs and therefore on ░░░░░░░░ basis alone can be ░░░░░░░░ out of the country ░░░░░░░░ enjoined that last week ░░░░░░░░ what he said on ░░░░░░░░ other ground was it ░░░░░░░░ highly unlikely that they ░░░░░░░░ detain him just for ░░░░░░░░ errors in his immigration ░░░░░░░░ He didn t squarely ░░░░░░░░ however that that was ░░░░░░░░ basis to also release ░░░░░░░░ and therefore there was ░░░░░░░░ briefing in the hearing ░░░░░░░░ Farbiarz finding today that ░░░░░░░░ is not tenable to ░░░░░░░░ detain him on the ░░░░░░░░ of this paperwork that ░░░░░░░░ s likely to succeed ░░░░░░░░ that ground as well ░░░░░░░░ ordering him released in ░░░░░░░░ habeas case that Khalil ░░░░░░░░ lawyers have brought on ░░░░░░░░ behalf Tur And he ░░░░░░░░ be meeting his baby ░░░░░░░░ the first time His ░░░░░░░░ gave birth when he ░░░░░░░░ he went into detention ░░░░░░░░ I have to just ░░░░░░░░ something there He has ░░░░░░░░ met his child He ░░░░░░░░ so at an earlier ░░░░░░░░ in time but through ░░░░░░░░ lot of legal wrangling ░░░░░░░░ order to get that ░░░░░░░░ person meeting Tur Okay ░░░░░░░░ at home at least ░░░░░░░░ Yeah Tur Julia What ░░░░░░░░ be next for the ░░░░░░░░ in this case Is ░░░░░░░░ anything that they might ░░░░░░░░ to do to take ░░░░░░░░ back into custody Ainsley ░░░░░░░░ I think they re ░░░░░░░░ to push for an ░░░░░░░░ judge to order him ░░░░░░░░ by ICE and not ░░░░░░░░ him bond The reason ░░░░░░░░ think that Katy is ░░░░░░░░ the arguments today in ░░░░░░░░ from the Trump Administration ░░░░░░░░ this federal court judge ░░░░░░░░ look you don t ░░░░░░░░ to rule on this ░░░░░░░░ an immigration judge could ░░░░░░░░ the same thing And ░░░░░░░░ don t need to ░░░░░░░░ federal resources in order ░░░░░░░░ do that Kind of ░░░░░░░░ rich argument in some ░░░░░░░░ because they ve been ░░░░░░░░ a lot of immigration ░░░░░░░░ cases to federal court ░░░░░░░░ But in this case ░░░░░░░░ seem to think an ░░░░░░░░ judge might rule differently ░░░░░░░░ that could be their ░░░░░░░░ path As Lisa said ░░░░░░░░ could appeal it up ░░░░░░░░ could try to get ░░░░░░░░ stay on this order ░░░░░░░░ they could also go ░░░░░░░░ immigration court I ve ░░░░░░░░ time and time again ░░░░░░░░ here in federal court ░░░░░░░░ Alexandria a federal judge ░░░░░░░░ this person no longer ░░░░░░░░ be in custody and ░░░░░░░░ ICE can arrest that ░░░░░░░░ right there in the ░░░░░░░░ And so that could ░░░░░░░░ a scenario that we ░░░░░░░░ play out here and ░░░░░░░░ his lawyers would have ░░░░░░░░ go to ICE and ░░░░░░░░ why he should be ░░░░░░░░ on bond.”
