Weissmann: Harvard’s Complaint Against Trump Revoking Enrollments of Foreign Students Is ‘Incredibly Strong’

Wallace Joining our coverage ░░░░░░░░ Dr Jeremy Faust He ░░░░░░░░ an assistant professor of ░░░░░░░░ medicine at Harvard Medical ░░░░░░░░ and editor in chief ░░░░░░░░ MedPage Today Also joining ░░░░░░░░ is former top official ░░░░░░░░ the Department of Justice ░░░░░░░░ legal analyst Andrew Weissmann ░░░░░░░░ I m going to ░░░░░░░░ with you first Is ░░░░░░░░ the Trump Administration did ░░░░░░░░ Harvard yesterday at all ░░░░░░░░ And I guess that ░░░░░░░░ to say is this ░░░░░░░░ block likely to become ░░░░░░░░ Is Harvard likely to ░░░░░░░░ able to count on ░░░░░░░░ legally WEISSMANN I think ░░░░░░░░ answer to that is ░░░░░░░░ And you don t ░░░░░░░░ have my word for ░░░░░░░░ You have the decision ░░░░░░░░ You re right Nicolle ░░░░░░░░ it is just a ░░░░░░░░ decision It s a ░░░░░░░░ restraining order But that ░░░░░░░░ sort of the first ░░░░░░░░ to being vindicated And ░░░░░░░░ having read the complaint ░░░░░░░░ to be fair to ░░░░░░░░ government we don t ░░░░░░░░ their side yet this ░░░░░░░░ written explanation But the ░░░░░░░░ complaint is incredibly strong ░░░░░░░░ it s not surprising ░░░░░░░░ me that they got ░░░░░░░░ injunction Just to make ░░░░░░░░ people understand what is ░░░░░░░░ legal claim here there ░░░░░░░░ really two main ones ░░░░░░░░ is a procedural claim ░░░░░░░░ there actually are all ░░░░░░░░ of procedures that are ░░░░░░░░ writing that the Department ░░░░░░░░ Homeland Security has to ░░░░░░░░ And Harvard has made ░░░░░░░░ really good case that ░░░░░░░░ haven t followed those ░░░░░░░░ In other words you ░░░░░░░░ t just get to ░░░░░░░░ a letter that says ░░░░░░░░ Harvard you re out ░░░░░░░░ are all sorts of ░░░░░░░░ of notice of a ░░░░░░░░ to cure of actually ░░░░░░░░ out the reasons like ░░░░░░░░ factual reasons for why ░░░░░░░░ re taking this action ░░░░░░░░ Harvard points out None ░░░░░░░░ that has happened They ░░░░░░░░ t complied with what ░░░░░░░░ Department of Homeland Security ░░░░░░░░ its own website says ░░░░░░░░ are required to do ░░░░░░░░ s one set of ░░░░░░░░ Then there s a ░░░░░░░░ serious challenge which is ░░░░░░░░ First Amendment challenge And ░░░░░░░░ would be one of ░░░░░░░░ many cases where the ░░░░░░░░ have struck down what ░░░░░░░░ administration is trying to ░░░░░░░░ on the grounds of ░░░░░░░░ First Amendment We see ░░░░░░░░ in just as one ░░░░░░░░ the law firm cases ░░░░░░░░ unanimously all four judges ░░░░░░░░ that have said that ░░░░░░░░ administration violated the First ░░░░░░░░ that I think is ░░░░░░░░ to happen again on ░░░░░░░░ permanent way with respect ░░░░░░░░ what is going on ░░░░░░░░ that there s a ░░░░░░░░ of the First Amendment ░░░░░░░░ is academic freedom viewpoint ░░░░░░░░ that is taking place ░░░░░░░░ So I think there ░░░░░░░░ two very strong grounds ░░░░░░░░ the papers.”
