░░░░░░░░ whether a federal court ░░░░░░░░ federal Court Can Issue ░░░░░░░░ nationwide injunction There s ░░░░░░░░ lot at stake there ░░░░░░░░ for our democracy defenders ░░░░░░░░ We filed the very ░░░░░░░░ case in the country ░░░░░░░░ Day saying Hey Donald ░░░░░░░░ You Don t get ░░░░░░░░ pick Who gets to ░░░░░░░░ a Citizen who s ░░░░░░░░ here the Constitution does ░░░░░░░░ this gets to a ░░░░░░░░ that you wrote for ░░░░░░░░ where the headline is ░░░░░░░░ quiet blockbuster ahead for ░░░░░░░░ Supreme Court So rather ░░░░░░░░ read this pull quote ░░░░░░░░ give us a thumbnail ░░░░░░░░ of issue ░░░░░░░░ injunctions And that has ░░░░░░░░ a major vehicle for ░░░░░░░░ like norms and others ░░░░░░░░ have been challenging the ░░░░░░░░ and the courts They ░░░░░░░░ been able to stop ░░░░░░░░ lot of the executive ░░░░░░░░ and orders that Trump ░░░░░░░░ issued through these nationwide ░░░░░░░░ So if the court ░░░░░░░░ those are no longer ░░░░░░░░ they re unconstitutional or ░░░░░░░░ should be narrowed down ░░░░░░░░ certain circumstances that could ░░░░░░░░ a very dramatic impact ░░░░░░░░ the state of play ░░░░░░░░ the litigation currently and ░░░░░░░░ forward I know It ░░░░░░░░ annoying to do predictions ░░░░░░░░ predictions What do you ░░░░░░░░ s going to happen ░░░░░░░░ are the justices going ░░░░░░░░ vote on this one ░░░░░░░░ you had to do ░░░░░░░░ betting pool right now ░░░░░░░░ case after ░░░░░░░░ they have split the ░░░░░░░░ While reaffirming Core principles ░░░░░░░░ for example with the ░░░░░░░░ cases where we represent ░░░░░░░░ coalition of Three dozen ░░░░░░░░ Every administration From Nixon ░░░░░░░░ Trump won saying hey ░░░░░░░░ can t Disappear people ░░░░░░░░ a Foreign country without ░░░░░░░░ process The supreme Court ░░░░░░░░ split the baby but ░░░░░░░░ were judges can issue ░░░░░░░░ injunctions without eliminating them ░░░░░░░░ But there are several ░░░░░░░░ who have been out ░░░░░░░░ on this issue including ░░░░░░░░ saying these are not ░░░░░░░░ And I think there ░░░░░░░░ an irony here in ░░░░░░░░ two issues converging on ░░░░░░░░ which is you know ░░░░░░░░ administration on otherwise would ░░░░░░░░ a pretty decent argument ░░░░░░░░ this but this is ░░░░░░░░ a poor vehicle for ░░░░░░░░ not only because it ░░░░░░░░ so wildly unpopular but ░░░░░░░░ because it has been ░░░░░░░░ rejected by every single ░░░░░░░░ that has accepted it ░░░░░░░░ every credible scholar and ░░░░░░░░ So you have the ░░░░░░░░ going up asking for ░░░░░░░░ procedural ruling and on ░░░░░░░░ the most unpopular distasteful ░░░░░░░░ of facts available And ░░░░░░░░ is right They re ░░░░░░░░ supposed to be considering ░░░░░░░░ merits of that order ░░░░░░░░ I ll be very ░░░░░░░░ to see what happens ░░░░░░░░ Thursday because if I ░░░░░░░░ one of the liberal ░░░░░░░░ I would not let ░░░░░░░░ conservative justices get away ░░░░░░░░ ignoring the merits of ░░░░░░░░ order because it s ░░░░░░░░ some abstraction They have ░░░░░░░░ case in front of ░░░░░░░░ There are real real ░░░░░░░░ involved Can we I ░░░░░░░░ to broaden the aperture ░░░░░░░░ because I know that ░░░░░░░░ arguments before the court ░░░░░░░░ nothing to do with ░░░░░░░░ citizenship but the fact ░░░░░░░░ the ░░░░░░░░ would be stateless You ░░░░░░░░ be concerned There is ░░░░░░░░ reason to assume that ░░░░░░░░ administration would stop where ░░░░░░░░ ve stopped And you ░░░░░░░░ right the order on ░░░░░░░░ table right now that ░░░░░░░░ at issue is a ░░░░░░░░ one But it s ░░░░░░░░ small step particularly if ░░░░░░░░ got the Supreme Court ░░░░░░░░ sign off on this ░░░░░░░░ for them to then ░░░░░░░░ to do
