NYT’s Brooks Defends Judge Dugan’s ‘Illegal’ Stand Against ‘Predatory’ FBI: ‘Sometimes Civil Disobedience Is Necessary’

NAWAZ There s this ░░░░░░░░ story we re tracking ░░░░░░░░ seems to mark a ░░░░░░░░ chapter in the ongoing ░░░░░░░░ agenda this administration now ░░░░░░░░ the FBI arresting and ░░░░░░░░ a sitting judge in ░░░░░░░░ Now the FBI says ░░░░░░░░ she obstructed their agents ░░░░░░░░ they were trying to ░░░░░░░░ an undocumented immigrant who ░░░░░░░░ in her courthouse It ░░░░░░░░ been reported she allowed ░░░░░░░░ to leave through a ░░░░░░░░ door But what does ░░░░░░░░ say to you now ░░░░░░░░ terms of what the ░░░░░░░░ is willing to do ░░░░░░░░ how this was carried ░░░░░░░░ BROOKS Well obviously they ░░░░░░░░ trying to send a ░░░░░░░░ of intimidation not only ░░░░░░░░ her but to all ░░░░░░░░ and maybe to all ░░░░░░░░ But I don t ░░░░░░░░ know the specific details ░░░░░░░░ this case whether she ░░░░░░░░ the guy out the ░░░░░░░░ door or whether she ░░░░░░░░ him So that s ░░░░░░░░ murky I don t ░░░░░░░░ to comment on this ░░░░░░░░ case But especially on ░░░░░░░░ issue of immigration there ░░░░░░░░ a lot of people ░░░░░░░░ are appalled by what ░░░░░░░░ administration is doing And ░░░░░░░░ will be times for ░░░░░░░░ disobedience And to me ░░░░░░░░ she let s say ░░░░░░░░ did escort this guy ░░░░░░░░ the door If federal ░░░░░░░░ agencies come to your ░░░░░░░░ and you help a ░░░░░░░░ escape that is two ░░░░░░░░ One it strikes me ░░░░░░░░ maybe something illegal but ░░░░░░░░ also strikes me as ░░░░░░░░ heroic And in times ░░░░░░░░ trouble then people are ░░░░░░░░ called to do civil ░░░░░░░░ And in my view ░░░░░░░░ people do civil disobedience ░░░░░░░░ have to pay the ░░░░░░░░ That s part of ░░░░░░░░ heroism of it frankly ░░░░░░░░ so you can both ░░░░░░░░ that she shouldn t ░░░░░░░░ legally done this and ░░░░░░░░ morally protecting somebody against ░░░░░░░░ not even in this ░░░░░░░░ but in other cases ░░░░░░░░ a predatory enforcement agency ░░░░░░░░ civil disobedience is necessary ░░░░░░░░ I don t know ░░░░░░░░ we will get to ░░░░░░░░ point but we could ░░░░░░░░ to this point in ░░░░░░░░ or months where acts ░░░░░░░░ civil disobedience on a ░░░░░░░░ of fronts may be ░░░░░░░░ And the Trump Administration ░░░░░░░░ probably welcome that kind ░░░░░░░░ fight but their opponents ░░░░░░░░ welcome that kind of ░░░░░░░░ And that s one ░░░░░░░░ the ways you can ░░░░░░░░ public opinion because one ░░░░░░░░ the ways authoritarians lose ░░░░░░░░ is when their opponents ░░░░░░░░ in a nonviolent way ░░░░░░░░ the authoritarians crack down ░░░░░░░░ That s the way ░░░░░░░░ delegitimize an authoritarian regime ░░░░░░░░ so that it may ░░░░░░░░ to that.”
