░░░░░░░░ you know a lot ░░░░░░░░ it Specifically involving Trump ░░░░░░░░ defense team arguing the ░░░░░░░░ Smith should no longer ░░░░░░░░ the special counsel wealth ░░░░░░░░ arguments to knock out ░░░░░░░░ counsels have been tried ░░░░░░░░ court after court before ░░░░░░░░ democratic appointed judges and ░░░░░░░░ appointed judges they have ░░░░░░░░ failed Cannon s skeptical ░░░░░░░░ of both sides what ░░░░░░░░ know from the hearing ░░░░░░░░ there is no legal ░░░░░░░░ to challenge the appointment ░░░░░░░░ special counsel Jack Smith ░░░░░░░░ there s no constitutional ░░░░░░░░ know regulatory infirmity This ░░░░░░░░ an example of judge ░░░░░░░░ s typical over caution ░░░░░░░░ she confronts these issues ░░░░░░░░ should not have wasted ░░░░░░░░ day on it Adams ░░░░░░░░ this conversation At least ░░░░░░░░ former federal prosecutor you ░░░░░░░░ what s going on ░░░░░░░░ lot better than those ░░░░░░░░ us who didn t ░░░░░░░░ to law school Do ░░░░░░░░ kenneth didn t issue have been rejected I ░░░░░░░░ judge cannon was being ░░░░░░░░ cautious She allowed the ░░░░░░░░ to make a record ░░░░░░░░ that s also why ░░░░░░░░ oddly allowed these friends ░░░░░░░░ the court to make ░░░░░░░░ arguments which I have ░░░░░░░░ say it was an ░░░░░░░░ step I have never ░░░░░░░░ it in my years ░░░░░░░░ practice and so I ░░░░░░░░ she s going to ░░░░░░░░ all of that back ░░░░░░░░ who are really really ░░░░░░░░ And again we don ░░░░░░░░ know what she s ░░░░░░░░ do but I think ░░░░░░░░ s unlikely that she ░░░░░░░░ move to remove Jack ░░░░░░░░ will find out fairly ░░░░░░░░ I suspect Phil Mattingly ░░░░░░░░ of judge cannon as ░░░░░░░░ well know have noted ░░░░░░░░ that other judges have ░░░░░░░░ rejected these sorts of ░░░░░░░░ about removing special counsels ░░░░░░░░ s been that s ░░░░░░░░ history right Not just ░░░░░░░░ I think you just ░░░░░░░░ to look at the ░░░░░░░░ and you can objectives ░░░░░░░░ say that whether it ░░░░░░░░ in the Hunter Biden ░░░░░░░░ counsel case Wednesday In this ░░░░░░░░ to the other Jack ░░░░░░░░ case against the former ░░░░░░░░ related it s election ░░░░░░░░ and January 6 Implications ░░░░░░░░ just for the former ░░░░░░░░ but for future presidents ░░░░░░░░ well as one of ░░░░░░░░ biggest questions on presidential ░░░░░░░░ that the Supreme Court ░░░░░░░░ contemplated in recent years ░░░░░░░░ the lower courts this ░░░░░░░░ that for the former ░░░░░░░░ has some immunity or ░░░░░░░░ immunity has been completely ░░░░░░░░ Even though sources and ░░░░░░░░ world didn t expect ░░░░░░░░ this would be accepted ░░░░░░░░ the high court during ░░░░░░░░ arguments the justices it ░░░░░░░░ open to at least ░░░░░░░░ even some limited immunity ░░░░░░░░ presidents which would mean ░░░░░░░░ whole case goes back ░░░░░░░░ to the lower courts ░░░░░░░░ a lot of folks ░░░░░░░░ asking well why is ░░░░░░░░ taking them so long ░░░░░░░░ ve been in no ░░░░░░░░ to move on This ░░░░░░░░ Smith asked him to ░░░░░░░░ this question back in ░░░░░░░░ instead they waited for ░░░░░░░░ to go through the ░░░░░░░░ process arrive at them ░░░░░░░░ now we re in ░░░░░░░░ last week What we ░░░░░░░░ will maybe b the ░░░░░░░░ week and we re ░░░░░░░░ waiting on this decision ░░░░░░░░ they re helping in ░░░░░░░░ Trump s strategy to ░░░░░░░░ lash taking a long ░░░░░░░░ but it s very ░░░░░░░░ decision that we re ░░░░░░░░ waiting for What do ░░░░░░░░ think at least what ░░░░░░░░ the most likely outcome ░░░░░░░░ to the oral argument ░░░░░░░░ most likely outcome is ░░░░░░░░ is going back to ░░░░░░░░ district court for some ░░░░░░░░ findings I think the ░░░░░░░░ is most likely going ░░░░░░░░ require the judge to ░░░░░░░░ what was official acts ░░░░░░░░ what we re unofficial ░░░░░░░░ seem like That s ░░░░░░░░ they were heading Going ░░░░░░░░ have to wait until ░░░░░░░░ see but no matter ░░░░░░░░ I think the important ░░░░░░░░ is that just like ░░░░░░░░ classified documents case it ░░░░░░░░ going to kick this ░░░░░░░░ farther down the road ░░░░░░░░ I don t see ░░░░░░░░ case going to trial ░░░░░░░░ for the election in ░░░░░░░░ So get to that ░░░░░░░░ if the strategy was ░░░░░░░░ the leg they have ░░░░░░░░ Do you see it ░░░░░░░░ course leases right There ░░░░░░░░ a test to get ░░░░░░░░ trial That case to ░░░░░░░░ But what you might ░░░░░░░░ is a mini trial ░░░░░░░░ if there s a ░░░░░░░░ for judge Chutkan in ░░░░░░░░ C She s got you re ░░░░░░░░ there is both comprehensive ░░░░░░░░ it s compelling in ░░░░░░░░ sense that it pulls ░░░░░░░░ a lot of examples ░░░░░░░░ she says prove their ░░░░░░░░ I have no reporting ░░░░░░░░ how the court is ░░░░░░░░ the timing of this ░░░░░░░░ case What I do ░░░░░░░░ though is particularly heading ░░░░░░░░ the November election what ░░░░░░░░ demonstrates more than anything ░░░░░░░░ is a 6 3 ░░░░░░░░ majority has actual repercussions ░░░░░░░░ have moved the court ░░░░░░░░ a very clear ideological ░░░░░░░░ on some of most ░░░░░░░░ And I think divisive ░░░░░░░░ inside the country that ░░░░░░░░ the way it works ░░░░░░░░ some level And I ░░░░░░░░ why people might not ░░░░░░░░ it or be viscerally ░░░░░░░░ to it but they ░░░░░░░░ acidic confirm judges And ░░░░░░░░ you re the Biden ░░░░░░░░ I think you re ░░░░░░░░ at this and you ░░░░░░░░ looking at the age ░░░░░░░░ the current the court ░░░░░░░░ you re making this ░░░░░░░░ central issue like Donald ░░░░░░░░ very effectively did 2016 ░░░░░░░░ key ruling we re ░░░░░░░░ waiting for as you ░░░░░░░░ this Paula on involving ░░░░░░░░ January 6 defendants it ░░░░░░░░ also impact the criminal ░░░░░░░░ potentially against Donald Trump
