░░░░░░░░ believe would speedily equip ░░░░░░░░ Fair jury and of ░░░░░░░░ we can get a ░░░░░░░░ jury in Manhattan I ░░░░░░░░ it s possible a ░░░░░░░░ of people have their ░░░░░░░░ but our friend Scharf ░░░░░░░░ about these Trump charges ░░░░░░░░ and we go to ░░░░░░░░ next guest who I ░░░░░░░░ may have met Will ░░░░░░░░ yesterday in court Deroy ░░░░░░░░ joins us now nationally ░░░░░░░░ columnist and Fox News ░░░░░░░░ dry when you and ░░░░░░░░ Scharf are in the ░░░░░░░░ room together that makes ░░░░░░░░ nervous you guys can ░░░░░░░░ be in the same ░░░░░░░░ at the same time ░░░░░░░░ like to use both ░░░░░░░░ you well it s ░░░░░░░░ good nervous not a ░░░░░░░░ nervous right of course ░░░░░░░░ course I don t ░░░░░░░░ you to swapping I ░░░░░░░░ I was fortunate enough ░░░░░░░░ be in the courtroom few bits of good ░░░░░░░░ was that I uh ░░░░░░░░ in and sat down ░░░░░░░░ the back room of ░░░░░░░░ courtroom and there was ░░░░░░░░ next to me None ░░░░░░░░ than uh Will Scharf ░░░░░░░░ sharp guy we had ░░░░░░░░ good conversation there and ░░░░░░░░ understand he s running ░░░░░░░░ attorney general in your ░░░░░░░░ so I wish him ░░░░░░░░ lot of luck and ░░░░░░░░ seems like somebody who ░░░░░░░░ a great job serving ░░░░░░░░ people of Missouri yep ░░░░░░░░ are all good uh ░░░░░░░░ things so you were ░░░░░░░░ let s get to ░░░░░░░░ the details the dirty ░░░░░░░░ details here of the ░░░░░░░░ to sit in that ░░░░░░░░ uh draw a picture ░░░░░░░░ us tell us what ░░░░░░░░ was like to witness ░░░░░░░░ you saw sure um ░░░░░░░░ it was uh pretty ░░░░░░░░ courtroom uh you know ░░░░░░░░ quite as plain as ░░░░░░░░ a high school classroom ░░░░░░░░ nothing too fancy White ░░░░░░░░ big bright overhead lights ░░░░░░░░ lots of cops I ░░░░░░░░ they about seven or ░░░░░░░░ cops walking around so ░░░░░░░░ anybody tried to pull ░░░░░░░░ funny you person be ░░░░░░░░ the ground cuffed in ░░░░░░░░ two seconds plus Secret ░░░░░░░░ agents and President Trump ░░░░░░░░ sitting up in up ░░░░░░░░ front on the left ░░░░░░░░ prosecu prosecution on the ░░░░░░░░ looking from the back ░░░░░░░░ the front uh the ░░░░░░░░ on the right side ░░░░░░░░ looking pretty focused uh ░░░░░░░░ casually dressed than might ░░░░░░░░ but you re not ░░░░░░░░ to be in coat ░░░░░░░░ tie there although some ░░░░░░░░ are kind of dressed ░░░░░░░░ and judge Marshon about ░░░░░░░░ we ve heard plenty ░░░░░░░░ presiding uh very soothing ░░░░░░░░ I thought and uh ░░░░░░░░ did rule uh quite ░░░░░░░░ bit against the defense ░░░░░░░░ he did have some ░░░░░░░░ in terms of objections ░░░░░░░░ so forth uh on ░░░░░░░░ behalf so it wasn ░░░░░░░░ I wasn t you ░░░░░░░░ defense 0 I mean ░░░░░░░░ prosecution 0 defense I ░░░░░░░░ was probably 2 3 ░░░░░░░░ favor of the uh ░░░░░░░░ maybe 13d in favor ░░░░░░░░ the defense um what ░░░░░░░░ most interesting was the ░░░░░░░░ in the uh closing ░░░░░░░░ I did a piece ░░░░░░░░ the American American spectator ░░░░░░░░ posted this morning and ░░░░░░░░ headline is in some ░░░░░░░░ s defense focuses on ░░░░░░░░ prosecution obsesses over adultry ░░░░░░░░ the defense case basically ░░░░░░░░ uh Todd blanch who ░░░░░░░░ President Trump s attorney ░░░░░░░░ opened saying this is ░░░░░░░░ documents case and this ░░░░░░░░ case deals with uh ░░░░░░░░ allegation of falsification of ░░░░░░░░ records and he said ░░░░░░░░ this is a basically ░░░░░░░░ case about uh you ░░░░░░░░ whether President Trump as ░░░░░░░░ president United States was ░░░░░░░░ a scheme to fals ░░░░░░░░ business records and um ░░░░░░░░ essentially deals with the ░░░░░░░░ issue of The Ledger ░░░░░░░░ what did The Ledger ░░░░░░░░ say uh in connection ░░░░░░░░ the checks that were ░░░░░░░░ to pay back uh ░░░░░░░░ or pay uh uh ░░░░░░░░ Cohen in relation to ░░░░░░░░ Stormy Daniels payments if ░░░░░░░░ will uh and I ░░░░░░░░ heard something very interesting ░░░░░░░░ not heard anywhere else ░░░░░░░░ heard it in the ░░░░░░░░ I had not heard ░░░░░░░░ before and that is ░░░░░░░░ the uh accounting system ░░░░░░░░ use has a software ░░░░░░░░ a pull down menu ░░░░░░░░ when you do the ░░░░░░░░ down menu you can ░░░░░░░░ the checks as you ░░░░░░░░ payroll uh utilties supplies ░░░░░░░░ it is and one ░░░░░░░░ those pull down menu ░░░░░░░░ was the term legal ░░░░░░░░ and according to uh ░░░░░░░░ attorney for um uh ░░░░░░░░ President Trump the term ░░░░░░░░ expenses was part of ░░░░░░░░ pull down menu and ░░░░░░░░ s what they used ░░░░░░░░ they got a bill ░░░░░░░░ a lawyer or a ░░░░░░░░ firm or anything like ░░░░░░░░ so it wasn t ░░░░░░░░ they came up with ░░░░░░░░ phrase legal expenses to ░░░░░░░░ up the Stormy Daniels ░░░░░░░░ this was the absolute ░░░░░░░░ he said they use ░░░░░░░░ same notation so all ░░░░░░░░ leg legal expenses could ░░░░░░░░ reviewed at the end ░░░░░░░░ the year so how ░░░░░░░░ are we having this ░░░░░░░░ uh nefarious diabolical scheme ░░░░░░░░ the these checks to ░░░░░░░░ Cohen were handled exactly ░░░░░░░░ same way as any ░░░░░░░░ check coming in from ░░░░░░░░ other lawyer or any ░░░░░░░░ law firm and once ░░░░░░░░ establish that if you ░░░░░░░░ okay these records are ░░░░░░░░ they re not fake ░░░░░░░░ or or doctorate or ░░░░░░░░ I think at that ░░░░░░░░ the entire case implodes ░░░░░░░░ this is a case ░░░░░░░░ documents uh so that ░░░░░░░░ the story meanwhile the ░░░░░░░░ went on and on ░░░░░░░░ on about you know ░░░░░░░░ slept with whom and ░░░░░░░░ which person was involv ░░░░░░░░ sexual fair with the ░░░░░░░░ and it was just ░░░░░░░░ like uh you know ░░░░░░░░ over sex listening to ░░░░░░░░ guy with a you ░░░░░░░░ over sex libido and ░░░░░░░░ point he actually managed ░░░░░░░░ addition to talking about ░░░░░░░░ these other you know ░░░░░░░░ Stormy Daniels case and ░░░░░░░░ named U McDougall he ░░░░░░░░ one point made a ░░░░░░░░ to what he called ░░░░░░░░ estrogen estrogen Mafia whatever ░░░░░░░░ is and then he ░░░░░░░░ to a man named ░░░░░░░░ McDougall who was one ░░░░░░░░ these people who was ░░░░░░░░ part of this uh ░░░░░░░░ to you know purchase ░░░░░░░░ bury stories he said ░░░░░░░░ McDougall uh cited her ░░░░░░░░ to appear on Dancing ░░░░░░░░ the Stars and this ░░░░░░░░ the prosec prosecutor said ░░░░░░░░ she could revive her ░░░░░░░░ and also not be ░░░░░░░░ next Monica Lewinsky unquote ░░░░░░░░ the prosecution managed to ░░░░░░░░ the name Monica Lewinsky ░░░░░░░░ their closing arguments so ░░░░░░░░ prosecution basically seems to ░░░░░░░░ this is a case ░░░░░░░░ sex and efforts to ░░░░░░░░ those stories about sex ░░░░░░░░ the defense attorney Todd ░░░░░░░░ said look this is ░░░░░░░░ to the indictment a ░░░░░░░░ case and the evidence ░░░░░░░░ uh President Trump and ░░░░░░░░ team uh doctoring or ░░░░░░░░ business records does not ░░░░░░░░ and on that basis ░░░░░░░░ should be acquitted on ░░░░░░░░ 34 counts you know ░░░░░░░░ just listening to those ░░░░░░░░ I can t help ░░░░░░░░ think that it s ░░░░░░░░ parallel to the political ░░░░░░░░ invested in uh this ░░░░░░░░ trial Republicans often go ░░░░░░░░ there and they re ░░░░░░░░ here are some facts ░░░░░░░░ are some numbers and ░░░░░░░░ America s like boring ░░░░░░░░ then the left is ░░░░░░░░ charged it s like ░░░░░░░░ party over there it ░░░░░░░░ wild and crazy and ░░░░░░░░ want to find out ░░░░░░░░ what it they they ░░░░░░░░ more uh of the ░░░░░░░░ that they have or ░░░░░░░░ voyerism that they have ░░░░░░░░ the left brings to ░░░░░░░░ table I don t ░░░░░░░░ if that s exactly ░░░░░░░░ same as what you ░░░░░░░░ yesterday in the courtroom ░░░░░░░░ what matters is what ░░░░░░░░ 12 jurors think you ░░░░░░░░ written pieces where you ░░░░░░░░ that you you have ░░░░░░░░ and confidence in the ░░░░░░░░ jury and I thought ░░░░░░░░ was an important piece ░░░░░░░░ you put out there ░░░░░░░░ that s not the ░░░░░░░░ that everybody on the ░░░░░░░░ looking in has about ░░░░░░░░ Trump s ability to ░░░░░░░░ fair a a good ░░░░░░░░ a fair trial in ░░░░░░░░ York what was your ░░░░░░░░ was your thought of ░░░░░░░░ two arguments one being ░░░░░░░░ sounds like way more ░░░░░░░░ than the others doesn ░░░░░░░░ mean anything about factual ░░░░░░░░ what about the jury ░░░░░░░░ s a very good ░░░░░░░░ yeah and and good ░░░░░░░░ you know people on ░░░░░░░░ right tend to think ░░░░░░░░ terms of graphs and ░░░░░░░░ and statistics left it ░░░░░░░░ wild and crazy you ░░░░░░░░ uh now I think ░░░░░░░░ what sort of counteracts ░░░░░░░░ impulse or those two ░░░░░░░░ as you mentioned them ░░░░░░░░ that the um defense ░░░░░░░░ argument closing argument was ░░░░░░░░ 2 hours and 11 ░░░░░░░░ I think it was ░░░░░░░░ the uh prosecutions U ░░░░░░░░ started about 2 P ░░░░░░░░ and ended about 8 ░░░░░░░░ P M with uh ░░░░░░░░ breaks and but I ░░░░░░░░ to leave to go ░░░░░░░░ Fox News I left ░░░░░░░░ 4 00 and my ░░░░░░░░ were starting to glaze ░░░░░░░░ over even though he ░░░░░░░░ talking about sex he ░░░░░░░░ somehow to make it ░░░░░░░░ very interesting uh that ░░░░░░░░ that s really quite ░░░░░░░░ challenge right um so ░░░░░░░░ I think if maybe ░░░░░░░░ hours of boring talk ░░░░░░░░ sex might might have ░░░░░░░░ the uh uh put ░░░░░░░░ ruined that that s ░░░░░░░░ yeah they wreck they ░░░░░░░░ wreck that imagine that ░░░░░░░░ they touch Goes to ░░░░░░░░ including sex talk so ░░░░░░░░ do you think the ░░░░░░░░ like were they attentive ░░░░░░░░ you trust them to ░░░░░░░░ this situation with the ░░░░░░░░ respect and care it ░░░░░░░░ well I only can ░░░░░░░░ about my experience on ░░░░░░░░ Manhattan juries and in ░░░░░░░░ my experience uh the ░░░░░░░░ of you know the ░░░░░░░░ Jury saying hey we ░░░░░░░░ here just to hand ░░░░░░░░ you know big checks ░░░░░░░░ plaintiffs and and let ░░░░░░░░ you know let prisoners ░░░░░░░░ just because we we ░░░░░░░░ like it uh my ░░░░░░░░ in in the on ░░░░░░░░ juries in which I ░░░░░░░░ two were civil one ░░░░░░░░ criminal uh they took ░░░░░░░░ U civic duty very ░░░░░░░░ they were very solemn ░░░░░░░░ it they were rather ░░░░░░░░ about it and the ░░░░░░░░ was look we have ░░░░░░░░ treat the justice system ░░░░░░░░ respect because someday we ░░░░░░░░ want the justice system ░░░░░░░░ respect us you know ░░░░░░░░ might be the ones ░░░░░░░░ are sitting there at ░░░░░░░░ at the um you ░░░░░░░░ defense table at the ░░░░░░░░ coming in trying to ░░░░░░░░ us up and we ░░░░░░░░ to have a jury ░░░░░░░░ our peers you know ░░░░░░░░ the evidence and Rule ░░░░░░░░ and u a couple ░░░░░░░░ people said hey you ░░░░░░░░ let s just give ░░░░░░░░ person some money and ░░░░░░░░ response from the other ░░░░░░░░ no no no we ░░░░░░░░ to make sure the ░░░░░░░░ is proved and in ░░░░░░░░ the case I m ░░░░░░░░ I m particular thinking ░░░░░░░░ particular was a very ░░░░░░░░ sympathetic plaintiff one person ░░░░░░░░ we got to give ░░░░░░░░ some money and the ░░░░░░░░ of us said no ░░░░░░░░ her lawyer didn t ░░░░░░░░ the case and we ░░░░░░░░ sorry for her and ░░░░░░░░ wish her all luck ░░░░░░░░ maybe we should buy ░░░░░░░░ some flowers but uh ░░░░░░░░ know he didn t ░░░░░░░░ the case and so ░░░░░░░░ sent her home with ░░░░░░░░ and she suffered a ░░░░░░░░ uh malpractice case she ░░░░░░░░ in a botched abortion ░░░░░░░░ think she was left ░░░░░░░░ I mean not a ░░░░░░░░ picture at all and ░░░░░░░░ woman walked home with ░░░░░░░░ not a penny in ░░░░░░░░ wallet because her lawyer ░░░░░░░░ t put the pieces ░░░░░░░░ and the defense attorney ░░░░░░░░ the doctors did a ░░░░░░░░ good job of explaining ░░░░░░░░ they did right and ░░░░░░░░ was very organized and ░░░░░░░░ to follow the other ░░░░░░░░ was like columbos all ░░░░░░░░ the map and just ░░░░░░░░ total wreck um so ░░░░░░░░ think if if my ░░░░░░░░ with Manhattan jur is ░░░░░░░░ at all representative uh ░░░░░░░░ people who may not ░░░░░░░░ Trump they may disagree ░░░░░░░░ him they want may ░░░░░░░░ vote against him uh ░░░░░░░░ think they re not ░░░░░░░░ to say let s ░░░░░░░░ this guy in prison ░░░░░░░░ because we don t ░░░░░░░░ him um I think ░░░░░░░░ ll maybe do that ░░░░░░░░ Ballot Box but I ░░░░░░░░ they will uh rule ░░░░░░░░ they should on the ░░░░░░░░ of the evidence and ░░░░░░░░ law and the instructions ░░░░░░░░ the judge now the ░░░░░░░░ from the judge or ░░░░░░░░ matter altogether and that ░░░░░░░░ seems really very weird ░░░░░░░░ know you re supposed ░░░░░░░░ find a defendant uh ░░░░░░░░ uh 12 people unanimously ░░░░░░░░ with Beyond a reasonable ░░░░░░░░ of all agreeing on ░░░░░░░░ same crime uh what ░░░░░░░░ M meran has has ░░░░░░░░ I ve never seen ░░░░░░░░ before is say look ░░░░░░░░ have a choice of ░░░░░░░░ crimes one is Federal ░░░░░░░░ crime which of course ░░░░░░░░ district attorney manhon has ░░░░░░░░ authority to uh to ░░░░░░░░ in which the Department ░░░░░░░░ Justice US Department of ░░░░░░░░ and the Federal Election ░░░░░░░░ both decided not to ░░░░░░░░ Trump over any of ░░░░░░░░ Stormy Daniels stuff number ░░░░░░░░ number two um uh ░░░░░░░░ issue of uh commercial ░░░░░░░░ fraud of some kind ░░░░░░░░ third I believe is ░░░░░░░░ faulty B uh false ░░░░░░░░ records and you know ░░░░░░░░ could have four people ░░░░░░░░ believe uh option one ░░░░░░░░ say yeah he s ░░░░░░░░ of option two and ░░░░░░░░ next four believe it ░░░░░░░░ option three kind of ░░░░░░░░ and choosing I ve ░░░░░░░░ heard of any jury ░░░░░░░░ operates that way it ░░░░░░░░ all supposed to be ░░░░░░░░ people agreeing on one ░░░░░░░░ not four with on ░░░░░░░░ one and four on ░░░░░░░░ other and four on ░░░░░░░░ third um so I ░░░░░░░░ t know where that ░░░░░░░░ from and I really ░░░░░░░░ people ignore that apparently ░░░░░░░░ instructions took an hour ░░░░░░░░ hear and they re ░░░░░░░░ out at 50 pages ░░░░░░░░ and nobody has a ░░░░░░░░ of it so they ░░░░░░░░ operating with instructions basically ░░░░░░░░ memory and very complicated ░░░░░░░░ so U I don ░░░░░░░░ know maybe the judge ░░░░░░░░ have been too cute ░░░░░░░░ half and left the ░░░░░░░░ in a situation where ░░░░░░░░ say look we can ░░░░░░░░ figure it out we ░░░░░░░░ reasonable suspicions we can ░░░░░░░░ put it all together ░░░░░░░░ we re just going ░░░░░░░░ vote till quit I ░░░░░░░░ hope that s what ░░░░░░░░ you ve you said ░░░░░░░░ you see the possibility ░░░░░░░░ an acquittal you ve ░░░░░░░░ about that we heard ░░░░░░░░ Turley say today that ░░░░░░░░ expects a hung jury ░░░░░░░░ Andy McCarthy has said ░░░░░░░░ he expects a conviction ░░░░░░░░ does your heart lie ░░░░░░░░ this issue I ve ░░░░░░░░ a lot of people ░░░░░░░░ I trust giving me ░░░░░░░░ the opportunities that it ░░░░░░░░ go any one of ░░░░░░░░ ways you know I ░░░░░░░░ it could go any ░░░░░░░░ of those ways I ░░░░░░░░ think the way that ░░░░░░░░ chief sort of star ░░░░░░░░ Michael Cohen was just ░░░░░░░░ um the defense attorney ░░░░░░░░ blanch came up with ░░░░░░░░ name for me called ░░░░░░░░ him gloat which is ░░░░░░░░ greatest liar of all ░░░░░░░░ and spent is that ░░░░░░░░ spent a long time ░░░░░░░░ dismantling this guy and ░░░░░░░░ look you know he ░░░░░░░░ he lied to the ░░░░░░░░ he lied to his ░░░░░░░░ he lied to his ░░░░░░░░ he lied to the ░░░░░░░░ to Congress the Senate ░░░░░░░░ the house and he ░░░░░░░░ but worst of all ░░░░░░░░ walked in here he ░░░░░░░░ his hand to take ░░░░░░░░ oath and then he ░░░░░░░░ to each one of ░░░░░░░░ pointing to the jury ░░░░░░░░ lied to the jury ░░░░░░░░ this case uh and ░░░░░░░░ think if people discount ░░░░░░░░ Cohen s testimony the ░░░░░░░░ case sort of just ░░░░░░░░ you know collapses so ░░░░░░░░ that s the case ░░░░░░░░ sense is uh I ░░░░░░░░ it s unlikely that ░░░░░░░░ will be convicted I ░░░░░░░░ out of the 12 ░░░░░░░░ there probably will be ░░░░░░░░ one two or three ░░░░░░░░ think look you know ░░░░░░░░ know you guys hate ░░░░░░░░ but this isn t ░░░░░░░░ um and it is ░░░░░░░░ to say look you ░░░░░░░░ we re not crazy ░░░░░░░░ this guy but we ░░░░░░░░ not you know we ░░░░░░░░ not here to throw ░░░░░░░░ in jail well we ░░░░░░░░ do what we have ░░░░░░░░ do with the polls ░░░░░░░░ November but that s ░░░░░░░░ different time and a ░░░░░░░░ place and a
