RUSH TRANSCRIPT He didn ░░░░░░░░ go into cardiac arrest ░░░░░░░░ Back with me are ░░░░░░░░ fang and Joyce Vance ░░░░░░░░ s start with Barry ░░░░░░░░ one of the experts ░░░░░░░░ He is an expert ░░░░░░░░ might not remember but ░░░░░░░░ case he most testified ░░░░░░░░ laquan McDonald that he ░░░░░░░░ it was a legitimate ░░░░░░░░ of force to shoot ░░░░░░░░ 16 times Officer Van ░░░░░░░░ in that case was ░░░░░░░░ of second degree murder ░░░░░░░░ aggravated battery He shot ░░░░░░░░ man running away 16 ░░░░░░░░ Barry thought that was ░░░░░░░░ perfectly fine use of ░░░░░░░░ He s attempting to ░░░░░░░░ how keeping him in ░░░░░░░░ prone position was not ░░░░░░░░ of force at all ░░░░░░░░ it doesn t hurt ░░░░░░░░ all The maintaining of ░░░░░░░░ prone control to me ░░░░░░░░ not a use of ░░░░░░░░ Why is it not ░░░░░░░░ use of force That ░░░░░░░░ a control technique Without ░░░░░░░░ it doesn t hurt ░░░░░░░░ need to ask you ░░░░░░░░ you believe that it ░░░░░░░░ unlikely that orienting yourself ░░░░░░░░ top of a person ░░░░░░░░ the pavement with both ░░░░░░░░ is unlikely to produce ░░░░░░░░ It could If this ░░░░░░░░ that we re looking ░░░░░░░░ in exhibit 17 could ░░░░░░░░ pain would you agree ░░░░░░░░ what we re seeing ░░░░░░░░ is a use of ░░░░░░░░ Shown in this picture ░░░░░░░░ could be a use ░░░░░░░░ force Okay Katie you ░░░░░░░░ here to explain the ░░░░░░░░ side of this What ░░░░░░░░ no I mean you ░░░░░░░░ the defense failed today ░░░░░░░░ was unlikable I don ░░░░░░░░ know why the defense ░░░░░░░░ him on other than ░░░░░░░░ maybe couldn t find ░░░░░░░░ else to testify for ░░░░░░░░ chauvin He failed at ░░░░░░░░ laquan McDonald trial so ░░░░░░░░ mean I don t ░░░░░░░░ if his track record ░░░░░░░░ so good What was ░░░░░░░░ critical about this expert ░░░░░░░░ that he was trying ░░░░░░░░ to show in a ░░░░░░░░ clini way that use ░░░░░░░░ force has to be ░░░░░░░░ you know compliant with ░░░░░░░░ procedures et cetera The ░░░░░░░░ is the defense must ░░░░░░░░ that the jury is ░░░░░░░░ paying attention because we ░░░░░░░░ from the actual guy ░░░░░░░░ mercil who said that ░░░░░░░░ that Derek chauvin used ░░░░░░░░ not taught by the ░░░░░░░░ pd so we already ░░░░░░░░ the person who is ░░░░░░░░ in charge of everything ░░░░░░░░ the chief of police ░░░░░░░░ we don t condone ░░░░░░░░ We don t authorize ░░░░░░░░ and the other critical ░░░░░░░░ made by the defense ░░░░░░░░ through this guy Barry ░░░░░░░░ He said you know ░░░░░░░░ you have to look ░░░░░░░░ what the reasonable officer ░░░░░░░░ doing meaning we need ░░░░░░░░ put the jury in ░░░░░░░░ shoes of this officer ░░░░░░░░ this officer can the ░░░░░░░░ can feel and determine ░░░░░░░░ or not he acted ░░░░░░░░ or objectively Here s ░░░░░░░░ problem and Joyce would ░░░░░░░░ with me as lawyers ░░░░░░░░ called the golden rule ░░░░░░░░ are not allowed to ░░░░░░░░ the members of the ░░░░░░░░ to put themselves in ░░░░░░░░ shoes of the party ░░░░░░░░ s a mistrial so ░░░░░░░░ s critically wrong with ░░░░░░░░ argument they re doing ░░░░░░░░ you ask the jurors ░░░░░░░░ of these 12 jurors ░░░░░░░░ put themselves in the ░░░░░░░░ of Derek chauvin none ░░░░░░░░ ever going to say ░░░░░░░░ that cop did was ░░░░░░░░ objectively subjectively wasn t ░░░░░░░░ so that was a ░░░░░░░░ mistake because none of ░░░░░░░░ jurors will say that ░░░░░░░░ 29 on somebody without ░░░░░░░░ pulse as something they ░░░░░░░░ ever do as a ░░░░░░░░ officer That was a ░░░░░░░░ problem One more Barry ░░░░░░░░ clip Him trying to ░░░░░░░░ resting comfortably in any ░░░░░░░░ related to George Floyd ░░░░░░░░ part of this is ░░░░░░░░ compliant So I see ░░░░░░░░ arm position in the ░░░░░░░░ that s posteds Right ░░░░░░░░ you know a compliant ░░░░░░░░ would have both their ░░░░░░░░ in the small of ░░░░░░░░ back and resting comfortably ░░░░░░░░ like he s still ░░░░░░░░ around Did you say ░░░░░░░░ comfortably Or laying comfortably ░░░░░░░░ comfortably on the pavement ░░░░░░░░ At this point in ░░░░░░░░ when he s attempting ░░░░░░░░ breathe by shoving his ░░░░░░░░ into the pavement I ░░░░░░░░ describing what the signs ░░░░░░░░ a perfect compliant person ░░░░░░░░ be So attempting to ░░░░░░░░ while restrained is being ░░░░░░░░ noncompliant No I m ░░░░░░░░ to leave that for ░░░░░░░░ audience to absorb and ░░░░░░░░ on to officer Peter ░░░░░░░░ the fifth officer there ░░░░░░░░ the other piece of ░░░░░░░░ defense case Joyce he ░░░░░░░░ trying to say the ░░░░░░░░ also killed George Floyd ░░░░░░░░ they were mean So ░░░░░░░░ is the other officers ░░░░░░░░ concern about that supposed ░░░░░░░░ Take a listen And ░░░░░░░░ assumed when you were ░░░░░░░░ that that those four ░░░░░░░░ were okay over there ░░░░░░░░ there were four of ░░░░░░░░ correct Yes And if ░░░░░░░░ had radioed for help ░░░░░░░░ would have heard it ░░░░░░░░ your radio Yes And ░░░░░░░░ never radioed for help ░░░░░░░░ he No That felt ░░░░░░░░ a strong cross to ░░░░░░░░ Joyce because it s ░░░░░░░░ If they were so ░░░░░░░░ why didn t they ░░░░░░░░ for backup The defense ░░░░░░░░ these witnesses on the ░░░░░░░░ to try to create ░░░░░░░░ doubt in the mind ░░░░░░░░ at least one juror ░░░░░░░░ they can avoid a ░░░░░░░░ verdict and this was ░░░░░░░░ a successful day for ░░░░░░░░ defense I don t ░░░░░░░░ You know the caveat ░░░░░░░░ is we can t ░░░░░░░░ the jury We don ░░░░░░░░ know how they re ░░░░░░░░ It s possible that ░░░░░░░░ defense has identified a ░░░░░░░░ that they re trying ░░░░░░░░ single out and hope ░░░░░░░░ that juror will hold ░░░░░░░░ against rendering a verdict ░░░░░░░░ nothing that we heard ░░░░░░░░ was really sufficient and ░░░░░░░░ ll make an interesting ░░░░░░░░ point the parties give ░░░░░░░░ judge their requests for ░░░░░░░░ instructions at the end ░░░░░░░░ the trial the judge ░░░░░░░░ instruct the jury about ░░░░░░░░ law and the jury ░░░░░░░░ obligated to apply that ░░░░░░░░ and the defense asked ░░░░░░░░ an instruction on expert ░░░░░░░░ and the instruction that ░░░░░░░░ wanted is a somewhat ░░░░░░░░ one that essentially tells ░░░░░░░░ jury they should use ░░░░░░░░ own judgment and use ░░░░░░░░ common sense and they ░░░░░░░░ reject an expert if ░░░░░░░░ doesn t comport with ░░░░░░░░ common sense and so ░░░░░░░░ back to Mr Brodd ░░░░░░░░ think the defense will ░░░░░░░░ having asked for an ░░░░░░░░ that s that strong ░░░░░░░░ what the jury saw ░░░░░░░░ was someone whose testimony ░░░░░░░░ was biased I mean ░░░░░░░░ s really what it ░░░░░░░░ down to didn t ░░░░░░░░ with the reality that ░░░░░░░░ jury has heard about ░░░░░░░░ has understood through their ░░░░░░░░ common sense and the ░░░░░░░░ looks like it was ░░░░░░░░ failure for the defense ░░░░░░░░ listen you guys are ░░░░░░░░ not me that is ░░░░░░░░ I looked at it ░░░░░░░░ well quite an attempt ░░░░░░░░ quite a miss Katie ░░░░░░░░ Joyce Vance as we
