RUSH TRANSCRIPT Brooklyn center ░░░░░░░░ like a sundowntown black ░░░░░░░░ better not be traveling ░░░░░░░░ sundown Katie fang trial ░░░░░░░░ joins me and Joyce ░░░░░░░░ and we were supposed ░░░░░░░░ have the mayor of ░░░░░░░░ city of Brooklyn center ░░░░░░░░ Mike Elliott but he ░░░░░░░░ was unavailable We received ░░░░░░░░ to our booking team ░░░░░░░░ said there s a ░░░░░░░░ that he s dealing ░░░░░░░░ and he s not ░░░░░░░░ any media tonight So ░░░░░░░░ was an interesting development ░░░░░░░░ I want to really ░░░░░░░░ Katie and Joyce for ░░░░░░░░ being in a bit ░░░░░░░░ to deal with what ░░░░░░░░ should have been dealing ░░░░░░░░ He had a rough ░░░░░░░░ today It was a ░░░░░░░░ day to be him ░░░░░░░░ Katie I want to ░░░░░░░░ through just a few ░░░░░░░░ these things just to ░░░░░░░░ off First of all ░░░░░░░░ fact that this young ░░░░░░░░ was pulled over for ░░░░░░░░ having a dangling air ░░░░░░░░ in his car and ░░░░░░░░ they said there was ░░░░░░░░ tag violation except that ░░░░░░░░ know because of Covid ░░░░░░░░ s been delays in ░░░░░░░░ sure that automobile tags ░░░░░░░░ given out in a ░░░░░░░░ manner because it s ░░░░░░░░ you have to physically ░░░░░░░░ in an office and ░░░░░░░░ if the thing that ░░░░░░░░ had a warrant out ░░░░░░░░ at least I ve ░░░░░░░░ in reporting it was ░░░░░░░░ misdemeanor so it wasn ░░░░░░░░ like he was some ░░░░░░░░ of serious master criminal ░░░░░░░░ me looking at this ░░░░░░░░ an attorney of how ░░░░░░░░ I ll ask each ░░░░░░░░ first Katie and then ░░░░░░░░ how likely does it ░░░░░░░░ like something we ll ░░░░░░░░ a prosecution come out ░░░░░░░░ Look you know unfortunately ░░░░░░░░ have to say as ░░░░░░░░ former prosecutor in two ░░░░░░░░ jurisdictions we had several ░░░░░░░░ that were based upon ░░░░░░░░ stops that were made ░░░░░░░░ the broken taillight being ░░░░░░░░ the expired tag the ░░░░░░░░ dark tips and that ░░░░░░░░ suspicion to effect that ░░░░░░░░ stop or to stop ░░░░░░░░ person in the car ░░░░░░░░ gives rise to probable ░░░░░░░░ to actually effect the ░░░░░░░░ so from a pure ░░░░░░░░ standpoint from law enforcement ░░░░░░░░ there was something wrong ░░░░░░░░ stopping vehicle was actually ░░░░░░░░ but then we actually ░░░░░░░░ into the idea that ░░░░░░░░ re pretext wall that ░░░░░░░░ re really not the ░░░░░░░░ issue the dangling of ░░░░░░░░ air freshener in and ░░░░░░░░ itself is not a ░░░░░░░░ or a traffic offense ░░░░░░░░ s the driving while ░░░░░░░░ pretext is what we ░░░░░░░░ going on here right ░░░░░░░░ unfortunately we have this ░░░░░░░░ less than 10 miles ░░░░░░░░ from where the Derek ░░░░░░░░ trial is going on ░░░░░░░░ we d like to ░░░░░░░░ that there would be ░░░░░░░░ criminal prosecution at a ░░░░░░░░ of manslaughter of former ░░░░░░░░ Kim potter but above ░░░░░░░░ and beyond the criminal ░░░░░░░░ briefly joy I d ░░░░░░░░ to touch on this ░░░░░░░░ s the idea of ░░░░░░░░ abolishing of qualified immunity ░░░░░░░░ idea that when you ░░░░░░░░ t hit them where ░░░░░░░░ hurts the most your ░░░░░░░░ sometimes where you can ░░░░░░░░ sue for the violation ░░░░░░░░ civil rights because there ░░░░░░░░ this immunity afforded to ░░░░░░░░ that are violating civil ░░░░░░░░ on a daily basis ░░░░░░░░ s really something that ░░░░░░░░ people this carte Blanche ░░░░░░░░ they can run around ░░░░░░░░ cops and do the ░░░░░░░░ thing and so I ░░░░░░░░ that we need to ░░░░░░░░ a conversation I know ░░░░░░░░ Minnesota just a couple ░░░░░░░░ weeks ago the house ░░░░░░░░ a new bill it ░░░░░░░░ t have a sister ░░░░░░░░ yet that allows for ░░░░░░░░ cause of action civilly ░░░░░░░░ sue a cop or ░░░░░░░░ peace officer for the ░░░░░░░░ of a constitutional right ░░░░░░░░ that s just you ░░░░░░░░ in the backyard of ░░░░░░░░ We need to see ░░░░░░░░ across the United States ░░░░░░░░ so I think that ░░░░░░░░ d like to see ░░░░░░░░ criminal prosecution but I ░░░░░░░░ love to see a ░░░░░░░░ case because I think ░░░░░░░░ s where people get ░░░░░░░░ unfortunately these days which ░░░░░░░░ money They re always ░░░░░░░░ thing important point In ░░░░░░░░ we see lieutenant Nazario ░░░░░░░░ personally suing the two ░░░░░░░░ who stopped him claiming ░░░░░░░░ fourth amendment violation suing ░░░░░░░░ individually and I believe ░░░░░░░░ department Some states you ░░░░░░░░ Some states you can ░░░░░░░░ Some have strong police ░░░░░░░░ of rights which afford ░░░░░░░░ police union which is ░░░░░░░░ last super strong powerful ░░░░░░░░ in the country they ░░░░░░░░ such a symbiotic relationship ░░░░░░░░ prosecutors they have such ░░░░░░░░ because they are team ░░░░░░░░ with prosecutors and there ░░░░░░░░ so very few types ░░░░░░░░ get prosecuted then you ░░░░░░░░ at Brooklyn center which ░░░░░░░░ 29 black it has ░░░░░░░░ second highest perjury of ░░░░░░░░ residents in all cities ░░░░░░░░ Minnesota one of only ░░░░░░░░ nonmajority white So it ░░░░░░░░ in a particular area ░░░░░░░░ you see police being ░░░░░░░░ stop a lot of ░░░░░░░░ because as Katie said ░░░░░░░░ s pretext wall You ░░░░░░░░ find other things you ░░░░░░░░ fine people over In ░░░░░░░░ Missouri used this for ░░░░░░░░ so black people become ░░░░░░░░ income generators we just ░░░░░░░░ them all until we ░░░░░░░░ enough crimes to charge ░░░░░░░░ center reminds me so ░░░░░░░░ joy of Ferguson and ░░░░░░░░ was something that mayor ░░░░░░░░ said at the press ░░░░░░░░ today that really grabbed ░░░░░░░░ attention he made the ░░░░░░░░ that none of their ░░░░░░░░ officers live inside of ░░░░░░░░ city Yep That was ░░░░░░░░ happened in Ferguson and ░░░░░░░░ all know that that ░░░░░░░░ what really makes it ░░░░░░░░ much easier for these ░░░░░░░░ to objectify people here ░░░░░░░░ you have a lot ░░░░░░░░ white police officers who ░░░░░░░░ t live in the ░░░░░░░░ as you point out ░░░░░░░░ become a profit making ░░░░░░░░ so it goes unchecked ░░░░░░░░ far too long What ░░░░░░░░ really points out is ░░░░░░░░ critical it is for ░░░░░░░░ Biden and Merrick Garland ░░░░░░░░ get their ducks in ░░░░░░░░ row at the Justice ░░░░░░░░ and get some of ░░░░░░░░ senior level people confirmed ░░░░░░░░ the Senate and in ░░░░░░░░ because it s clear ░░░░░░░░ DoJ will have a ░░░░░░░░ of work on its ░░░░░░░░ going back to the ░░░░░░░░ decree process that s ░░░░░░░░ to transform entire police ░░░░░░░░ to require them to ░░░░░░░░ just pay lip service ░░░░░░░░ to actually update use ░░░░░░░░ force policies to train ░░░░░░░░ to engage in communities ░░░░░░░░ you know your original ░░░░░░░░ was will there be ░░░░░░░░ prosecution I think there ░░░░░░░░ likely be one here ░░░░░░░░ law which will be ░░░░░░░░ if the George Floyd ░░░░░░░░ passes in the Senate ░░░░░░░░ it has in the ░░░░░░░░ will make it easier ░░░░░░░░ federal prosecutors to prosecute ░░░░░░░░ now it s really ░░░░░░░░ because you have to ░░░░░░░░ a malicious intent to ░░░░░░░░ someone of their civil ░░░░░░░░ and that s a ░░░░░░░░ standard but the state ░░░░░░░░ Minnesota has shown that ░░░░░░░░ s prosecuting The problem ░░░░░░░░ it looks more like ░░░░░░░░ manslaughter or maybe even ░░░░░░░░ sort of a negligence ░░░░░░░░ than a murder Yeah ░░░░░░░░ feel like the ghost ░░░░░░░░ philando Castile which happened ░░░░░░░░ that state is hovering ░░░░░░░░ but if police departments ░░░░░░░░ people that were color ░░░░░░░░ in the administration of justice
