    RUSH TRANSCRIPT I want ░░░░░░░░ bring in two people ░░░░░░░░ have been following this ░░░░░░░░ closely throughout these first ░░░░░░░░ weeks David Henderson civil ░░░░░░░░ attorney and former prosecutor ░░░░░░░░ Katie fang former prosecutor ░░░░░░░░ Broward county and Miami ░░░░░░░░ county Let s start ░░░░░░░░ today with the medical ░░░░░░░░ I know again there ░░░░░░░░ always been the trial ░░░░░░░░ and a public narrative ░░░░░░░░ I know that again ░░░░░░░░ sort of code of ░░░░░░░░ who attempted to spin ░░░░░░░░ the plain truth of ░░░░░░░░ we ve seen have ░░░░░░░░ to say that the ░░░░░░░░ examiner s report shows ░░░░░░░░ was complicated And it ░░░░░░░░ t The police officer ░░░░░░░░ actually killed George Floyd ░░░░░░░░ that other seemed to ░░░░░░░░ part of the implication ░░░░░░░░ the back and forth ░░░░░░░░ What was the goal ░░░░░░░░ the prosecution the defense ░░░░░░░░ in those exchanges So ░░░░░░░░ goal today was to ░░░░░░░░ to do what we ░░░░░░░░ seen so far with ░░░░░░░░ medical testimony of this ░░░░░░░░ which has been this ░░░░░░░░ choreography in terms of ░░░░░░░░ presentation of what is ░░░░░░░░ very complex and very ░░░░░░░░ of complicated medical concepts ░░░░░░░░ are reduced to easily ░░░░░░░░ ideas for the members ░░░░░░░░ jury And that is ░░░░░░░░ the state has done ░░░░░░░░ well over the last ░░░░░░░░ of days We saw ░░░░░░░░ through Dr Tobin the ░░░░░░░░ Dr Thomas the forensic ░░░░░░░░ trained Dr Baker He ░░░░░░░░ the final punch today ░░░░░░░░ behalf of the prosecution ░░░░░░░░ the defense did what ░░░░░░░░ could possibly do which ░░░░░░░░ create as much reasonable ░░░░░░░░ as possible and that ░░░░░░░░ what I want to ░░░░░░░░ everybody Chris right At ░░░░░░░░ end of the day ░░░░░░░░ s the state s ░░░░░░░░ to prove to the ░░░░░░░░ of every reasonable doubt ░░░░░░░░ case And if the ░░░░░░░░ can get just one ░░░░░░░░ just one to hold ░░░░░░░░ and not find Derek ░░░░░░░░ guilty of one of ░░░░░░░░ three charges he s ░░░░░░░░ then you re not ░░░░░░░░ to get a guilty ░░░░░░░░ What s important in ░░░░░░░░ of the take away ░░░░░░░░ today s medical testimony ░░░░░░░░ the following There are ░░░░░░░░ to be jury instructions ░░░░░░░░ are going to be ░░░░░░░░ to the members of ░░░░░░░░ jury before they deliberate ░░░░░░░░ within these jury instructions ░░░░░░░░ a definition of cause ░░░░░░░░ to cause We heard ░░░░░░░░ lot about whether it ░░░░░░░░ the primary cause of ░░░░░░░░ et cetera And the ░░░░░░░░ instructions itself state that ░░░░░░░░ cause it it doesn ░░░░░░░░ have to be the ░░░░░░░░ thing As long as ░░░░░░░░ s a substantial causal ░░░░░░░░ in the death It ░░░░░░░░ be one of many ░░░░░░░░ as long as it ░░░░░░░░ substantial then that can ░░░░░░░░ the day for the ░░░░░░░░ And so I think ░░░░░░░░ all of the hay ░░░░░░░░ s being made by ░░░░░░░░ defense about pre existing ░░░░░░░░ conditions drugs in the ░░░░░░░░ it s not going ░░░░░░░░ work I don t ░░░░░░░░ it s going to ░░░░░░░░ Yeah I have to ░░░░░░░░ just in a non ░░░░░░░░ sense Dave right so ░░░░░░░░ this this was true ░░░░░░░░ the trial watching the ░░░░░░░░ If you were to ░░░░░░░░ up on an elderly ░░░░░░░░ and punch them with ░░░░░░░░ their force and that ░░░░░░░░ were to hit the ░░░░░░░░ and die from their ░░░░░░░░ And then it turned ░░░░░░░░ they were on blood ░░░░░░░░ had a heart condition ░░░░░░░░ were just out of ░░░░░░░░ hospital it would hardly ░░░░░░░░ exculpatory to say well ░░░░░░░░ had a lot of ░░░░░░░░ conditions and that was ░░░░░░░░ the reason It s ░░░░░░░░ well you punched the ░░░░░░░░ That s the proximate ░░░░░░░░ here That s the ░░░░░░░░ we re prosecuting I ░░░░░░░░ a hard time sifting ░░░░░░░░ the legal significance against ░░░░░░░░ three charges about what ░░░░░░░░ state has to show ░░░░░░░░ a vis cause to ░░░░░░░░ the highest charge they ░░░░░░░░ gunning for Chris I ░░░░░░░░ the way you put ░░░░░░░░ What you have to ░░░░░░░░ on is what s ░░░░░░░░ to prove each of ░░░░░░░░ charges individually So let ░░░░░░░░ start with the highest ░░░░░░░░ the second degree murder ░░░░░░░░ Remember it s an ░░░░░░░░ murder charge He s ░░░░░░░░ for committing murder as ░░░░░░░░ result of assaulting George ░░░░░░░░ You have to prove ░░░░░░░░ he intentionally assaulted him ░░░░░░░░ moved on to the ░░░░░░░░ degree charge You basically ░░░░░░░░ to prove he did ░░░░░░░░ that placed George Floyd ░░░░░░░░ the imminent risk for ░░░░░░░░ depraved mind There s ░░░░░░░░ heightened risk that you ░░░░░░░░ the conduct is going ░░░░░░░░ result if had a ░░░░░░░░ cause And you move ░░░░░░░░ to the manslaughter charge ░░░░░░░░ it s a negligent ░░░░░░░░ where did you behave ░░░░░░░░ way a reasonable person ░░░░░░░░ have under the circumstances ░░░░░░░░ s the thing None ░░░░░░░░ that means absolutely anything ░░░░░░░░ real life Lawyers come ░░░░░░░░ with terminology to describe ░░░░░░░░ type of conduct But ░░░░░░░░ s what it s ░░░░░░░░ It s like me ░░░░░░░░ to my wife and ░░░░░░░░ I love you and ░░░░░░░░ says I love you ░░░░░░░░ And I say I ░░░░░░░░ you to the moon ░░░░░░░░ back How much more ░░░░░░░░ to the moon and ░░░░░░░░ versus I love you ░░░░░░░░ We talk about these ░░░░░░░░ but they do t ░░░░░░░░ that much And I ░░░░░░░░ to the extent I ░░░░░░░░ so sorry I thought ░░░░░░░░ were No no Go ░░░░░░░░ I was going to ░░░░░░░░ what it comes down ░░░░░░░░ is what is a ░░░░░░░░ s gut reaction to ░░░░░░░░ they re seeing And ░░░░░░░░ think we ve established ░░░░░░░░ Derek chauvin deserves to ░░░░░░░░ convicted I think causation ░░░░░░░░ intent is less clear ░░░░░░░░ in a case this ░░░░░░░░ it may not matter ░░░░░░░░ that s so well ░░░░░░░░ because obviously there is ░░░░░░░░ is a sort of ░░░░░░░░ legal distinction between the ░░░░░░░░ charges and the threshold ░░░░░░░░ state has But then ░░░░░░░░ re dealing with the ░░░░░░░░ enterprise of a jury ░░░░░░░░ it s a jury ░░░░░░░░ we should note again ░░░░░░░░ context here which gives ░░░░░░░░ a little bit of ░░░░░░░░ pit in my stomach ░░░░░░░░ s a jury that ░░░░░░░░ been screened for having ░░░░░░░░ or minimal knowledge for ░░░░░░░░ was the most ubiquitous ░░░░░░░░ in years And to ░░░░░░░░ s point the neck ░░░░░░░░ question of causation seems ░░░░░░░░ important than was this ░░░░░░░░ what happened or not ░░░░░░░░ was kind of the ░░░░░░░░ right Yes so listen ░░░░░░░░ biases prejudices and you ░░░░░░░░ people you ve got ░░░░░░░░ leave at the door ░░░░░░░░ you serve as a ░░░░░░░░ of the jury But ░░░░░░░░ reality is you carry ░░░░░░░░ baggage with you always ░░░░░░░░ s ironic that the ░░░░░░░░ themselves that were the ░░░░░░░░ that resonated globally in ░░░░░░░░ of George Floyd was ░░░░░░░░ they were looking to ░░░░░░░░ these members of the ░░░░░░░░ not know about That ░░░░░░░░ why it s been ░░░░░░░░ critical that the prosecution ░░░░░░░░ done its presentation by ░░░░░░░░ with the civilian witnesses ░░░░░░░░ then going to the ░░░░░░░░ body cam videos themselves ░░░░░░░░ we re moving into ░░░░░░░░ police use of force ░░░░░░░░ Now we re in ░░░░░░░░ medical experts That is ░░░░░░░░ the actual presentation of ░░░░░░░░ case is theater Chris ░░░░░░░░ is theater And so ░░░░░░░░ state has basically said ░░░░░░░░ are going to take ░░░░░░░░ through this journey And ░░░░░░░░ the end we re ░░░░░░░░ to ask you to ░░░░░░░░ And you are know ░░░░░░░░ Dave is right There ░░░░░░░░ three different charges They ░░░░░░░░ have to pick one ░░░░░░░░ don t have to ░░░░░░░░ all three And Derek ░░░░░░░░ s going to get ░░░░░░░░ up So really chauvin ░░░░░░░░ got a lot of ░░░░░░░░ here and his attorney ░░░░░░░░ doing the best that ░░░░░░░░ think he can with ░░░░░░░░ little on that menu ░░░░░░░░ him to choose from ░░░░░░░░ on that note Dave ░░░░░░░░ know we re expecting ░░░░░░░░ prosecution to rest next ░░░░░░░░ Again this is there ░░░░░░░░ two kind of counterveiling ░░░░░░░░ here One is that ░░░░░░░░ is hard to convict ░░░░░░░░ officers We ve seen ░░░░░░░░ time and time again ░░░░░░░░ the other hand this ░░░░░░░░ one of the most ░░░░░░░░ and documented uses of ░░░░░░░░ by a police officer ░░░░░░░░ cause someone s death ░░░░░░░░ we ve seen in ░░░░░░░░ very long time What ░░░░░░░░ you expect from the ░░░░░░░░ next week So I ░░░░░░░░ with what you re ░░░░░░░░ It s actual a ░░░░░░░░ whammy On the one ░░░░░░░░ you have to convict ░░░░░░░░ police officer You re ░░░░░░░░ convicting someone of an ░░░░░░░░ murder which is always ░░░░░░░░ In terms of the ░░░░░░░░ they re going to ░░░░░░░░ to the same tired ░░░░░░░░ they ve taken which ░░░░░░░░ going to blame health ░░░░░░░░ and drug use as ░░░░░░░░ factors On the one ░░░░░░░░ I despice that At ░░░░░░░░ same time it tends ░░░░░░░░ work Some people saw ░░░░░░░░ video and put blue ░░░░░░░░ matter signs in their ░░░░░░░░ yard This was not ░░░░░░░░ right way for the ░░░░░░░░ to try this case ░░░░░░░░ this gets at a ░░░░░░░░ issue that s associated ░░░░░░░░ this trial Derek chauvin ░░░░░░░░ is not on trial ░░░░░░░░ policing is on trial ░░░░░░░░ part of the problem ░░░░░░░░ the way this case ░░░░░░░░ been presented is it ░░░░░░░░ hard to draw the ░░░░░░░░ between effective trial strategy ░░░░░░░░ what s good in ░░░░░░░░ life I think it ░░░░░░░░ effective trial strategy to ░░░░░░░░ a commercial for the ░░░░░░░░ police department which we ░░░░░░░░ received in this trial ░░░░░░░░ if you have a ░░░░░░░░ lives matter juror you ░░░░░░░░ t want to alienate ░░░░░░░░ At the same time ░░░░░░░░ ve done that at ░░░░░░░░ expense of holding the ░░░░░░░░ police department accountable for ░░░░░░░░ role they played in ░░░░░░░░ Derek chauvin killed George ░░░░░░░░ He deserves to be ░░░░░░░░ But part of the ░░░░░░░░ that happened is because ░░░░░░░░ inadequate training and supervision ░░░░░░░░ policies that enabled him ░░░░░░░░ do it in the ░░░░░░░░ place because let s ░░░░░░░░ forget there were three ░░░░░░░░ officers there with him ░░░░░░░░ he did that And ░░░░░░░░ think that had the ░░░░░░░░ taken that approach what ░░░░░░░░ guy did was wrong ░░░░░░░░ it s part of ░░░░░░░░ much bigger systemic problem ░░░░░░░░ could have calculated potentially ░░░░░░░░ convicted of manslaughter which ░░░░░░░░ not be a win ░░░░░░░░ the community or possibly ░░░░░░░░ acquitted with some likelihood ░░░░░░░░ anticipating the outcome of ░░░░░░░░ trial That s very ░░░░░░░░ David Henderson and Katie
