begin with ░░░░░░░░ D C Office What ░░░░░░░░ been done as it ░░░░░░░░ the legal challenges for ░░░░░░░░ Trump facing charges for ░░░░░░░░ insurrection CORDERO The charges ░░░░░░░░ for the insurrection itself ░░░░░░░░ ve got a wide ░░░░░░░░ and it would be ░░░░░░░░ attorney s office and ░░░░░░░░ district of Columbia who ░░░░░░░░ handle both local and ░░░░░░░░ crimes They re the ░░░░░░░░ running the investigation into ░░░░░░░░ insurrection charging many of ░░░░░░░░ individuals who were on ░░░░░░░░ premises involved in that ░░░░░░░░ One of the things ░░░░░░░░ might be looking at ░░░░░░░░ seditious conspiracy which is ░░░░░░░░ charge of overtaking the ░░░░░░░░ or pro venting the ░░░░░░░░ of a law by ░░░░░░░░ And so it s ░░░░░░░░ federal statute that really ░░░░░░░░ in my judgment meet ░░░░░░░░ took place that day ░░░░░░░░ s possible that they ░░░░░░░░ be looking at the ░░░░░░░░ and his incitement that ░░░░░░░░ Other individuals who were ░░░░░░░░ not just in the ░░░░░░░░ of the Capitol but ░░░░░░░░ the planning of it ░░░░░░░░ well But I have ░░░░░░░░ point out that Mitch ░░░░░░░░ s statements are partly ░░░░░░░░ because the constitutional remedy ░░░░░░░░ a president who violates ░░░░░░░░ oath which is basically ░░░░░░░░ Mitch McConnell accused him ░░░░░░░░ doing by inciting this ░░░░░░░░ and by not stopping ░░░░░░░░ as the day was ░░░░░░░░ on that constitutional remedy ░░░░░░░░ impeachment conviction So while ░░░░░░░░ are criminal charges available ░░░░░░░░ really doesn t absolve ░░░░░░░░ Senate Republicans who failed ░░░░░░░░ convict WHITFIELD But of ░░░░░░░░ you heard Mitch McConnell ░░░░░░░░ earlier argument and that ░░░░░░░░ other Republican senators who ░░░░░░░░ believe that it was ░░░░░░░░ constitutional to try to ░░░░░░░░ after a former president ░░░░░░░░ though the body voted ░░░░░░░░ it and said it ░░░░░░░░ a constitutional matter CORDERO ░░░░░░░░ they voted on it ░░░░░░░░ the Senate voted on ░░░░░░░░ that was the end ░░░░░░░░ that issue and they ░░░░░░░░ supposed to go forward ░░░░░░░░ s why somebody like ░░░░░░░░ burr once they moved ░░░░░░░░ in that procedural vote ░░░░░░░░ at the merits of ░░░░░░░░ case That was what ░░░░░░░░ senator s job was ░░░░░░░░ look at the merits ░░░░░░░░ the case once they ░░░░░░░░ beyond that procedure WHITFIELD ░░░░░░░░ page outside the insurrection ░░░░░░░░ calls to Georgia asking ░░░░░░░░ to find 11 789 ░░░░░░░░ and then a separate ░░░░░░░░ call involving a phone ░░░░░░░░ to Georgia officials What ░░░░░░░░ the potential charges here ░░░░░░░░ Well Fred I think ░░░░░░░░ is certainly the potential ░░░░░░░░ criminal charges in Fulton ░░░░░░░░ for Trump s phone ░░░░░░░░ to the secretary of ░░░░░░░░ and other people in ░░░░░░░░ office The district attorney ░░░░░░░░ Fulton County and someone ░░░░░░░░ have known personally for ░░░░░░░░ She is very smart ░░░░░░░░ is very aggressive and ░░░░░░░░ what I am able ░░░░░░░░ tell she is putting ░░░░░░░░ foot to the gas ░░░░░░░░ this criminal investigation Now ░░░░░░░░ potential punishment here is ░░░░░░░░ only a misdemeanor There ░░░░░░░░ rules about solicitation of ░░░░░░░░ election which I think ░░░░░░░░ was clearly doing when ░░░░░░░░ placed those phone calls ░░░░░░░░ me some extra votes ░░░░░░░░ is a request to ░░░░░░░░ election official to tamper ░░░░░░░░ the vote and that ░░░░░░░░ illegal in Georgia It ░░░░░░░░ a misdemeanor but it ░░░░░░░░ still a crime WHITFIELD ░░░░░░░░ the most incriminating evidence ░░░░░░░░ the recorded phone call ░░░░░░░░ everyone got to hear ░░░░░░░░ from raffensperger the secretary ░░░░░░░░ state in Georgia his ░░░░░░░░ PATE Exactly and it ░░░░░░░░ crystal clear The only ░░░░░░░░ question is of intent ░░░░░░░░ that a political statement ░░░░░░░░ I hope you can ░░░░░░░░ 11 780 votes or ░░░░░░░░ he instructing them to ░░░░░░░░ something illegal That will ░░░░░░░░ a juror question If ░░░░░░░░ does decide to charge ░░░░░░░░ will be a jury ░░░░░░░░ WHITFIELD And we have ░░░░░░░░ civil charges in New ░░░░░░░░ having to do with ░░░░░░░░ Trump Administration This is ░░░░░░░░ deal where his state ░░░░░░░░ federal tax returns could ░░░░░░░░ released CORDERO I think ░░░░░░░░ does have sufficient exposure ░░░░░░░░ it comes to those ░░░░░░░░ in particular because those ░░░░░░░░ investigations where some of ░░░░░░░░ conduct has to do ░░░░░░░░ his activity before he ░░░░░░░░ became president So they ░░░░░░░░ had the entire length ░░░░░░░░ his presidency to conduct ░░░░░░░░ investigations They wouldn t ░░░░░░░░ brought them while he ░░░░░░░░ president obviously but now ░░░░░░░░ he is a private ░░░░░░░░ again and much of ░░░░░░░░ investigations pertain to activity ░░░░░░░░ he engaged in prior ░░░░░░░░ becoming president I would ░░░░░░░░ that if they have ░░░░░░░░ facts that demonstrate they ░░░░░░░░ move forward that they ░░░░░░░░ be able to do ░░░░░░░░ now fairly soon WHITFIELD ░░░░░░░░ then page there again ░░░░░░░░ these defamation lawsuits that ░░░░░░░░ largely delayed because the ░░░░░░░░ was in office now ░░░░░░░░ he fair game Both ░░░░░░░░ these cases we re ░░░░░░░░ about are by women ░░░░░░░░ accused Trump of sexual ░░░░░░░░ Do you expect these ░░░░░░░░ to be able to ░░░░░░░░ forward now unlike they ░░░░░░░░ been able to before ░░░░░░░░ Absolutely I mean Trump ░░░░░░░░ has no defense that ░░░░░░░░ can postpone depositions are ░░░░░░░░ to provide information in ░░░░░░░░ Those lawsuits will move ░░░░░░░░ just like any other ░░░░░░░░ against any private individual ░░░░░░░░ we all know Trump ░░░░░░░░ no stranger to litigation ░░░░░░░░ I m certain he ░░░░░░░░ be lawyered up so ░░░░░░░░ speak and he ll ░░░░░░░░ what he can to ░░░░░░░░ those lawsuits but defamation ░░░░░░░░ pretty clear as well ░░░░░░░░ you make a false ░░░░░░░░ about someone and
