ELLIS: "Yeah, well, again, this is something where Bernie Sanders and everyone else needs to understand that the First Amendment protects the freedom of the press to publish things that are verifiably and factually true, and also opinion statements. This particular piece — and 'The New York Times' has had a systematic pattern of bias against the campaign, but this particular instance alleged a fact that was knowingly false at the time that it was stated. It’s not going to inoculate them against liability just because they couch it as an opinion piece. It would be the same thing as if I said in an opinion piece that Bernie Sanders was dropping out of the race and he's switching his voter registration to Republican, and then go on to comment about it. That’s not fair, that would be alleging false facts."
