Judge Nap Says National Emergency Unlikely to Get Trump His Wall: ‘The Law Is Clear’

‘I think it’s pretty clear that court will stop him from doing that’

NAPOLITANO: "A couple of things. This remark about the president being forced made all of us talk about this. Force the president to do something? Is he telling us something that he knows and we don't because he is on that bipartisan committee. Lbj's famous line. Two things you never want to see being made, sausage and legislation. He is on the legislation end of I think the law is very clear and I think the president has been advised of it that if he signs an executive order declaring a national emergency and directing the military to spend money that has not been expressly appropriated for the wall or that has not been expressly appropriated for eminent domain. Much of the real estate they want to build the wall is privately owned. A court will stop him from doing that. He might do it anyway. Then he is relieved of the political pressure from his base, which has said he caved on the wall saying I didn't cave, I was stopped by a black robed judge who doesn't understand this as well as I do. So he might even be able to claim some measure of political victory if he signs the order."
