Jennifer ░░░░░░░░ a law professor at ░░░░░░░░ mason university Jennifer also ░░░░░░░░ as a law clerk ░░░░░░░░ Supreme Court Justice Clarence ░░░░░░░░ and then judge Brett ░░░░░░░░ Thank you very much ░░░░░░░░ joining me on this ░░░░░░░░ me your initial take ░░░░░░░░ this ruling today overturning ░░░░░░░░ action was it something ░░░░░░░░ expected Did you see ░░░░░░░░ coming down the pike ░░░░░░░░ thank you so much ░░░░░░░░ having me Today six ░░░░░░░░ majority found that it ░░░░░░░░ not constitutional to discriminate ░░░░░░░░ university admissions on the ░░░░░░░░ of race and that ░░░░░░░░ cannot consider race as ░░░░░░░░ independent separate factor But ░░░░░░░░ court does say at ░░░░░░░░ very end of the ░░░░░░░░ that race can be ░░░░░░░░ impacted another aspect of ░░░░░░░░ background or circumstance that ░░░░░░░░ applicant can discuss and ░░░░░░░░ can consider race as ░░░░░░░░ would any other factor ░░░░░░░░ just can t be ░░░░░░░░ as an independent basis ░░░░░░░░ I think one thing ░░░░░░░░ that probably really weighed ░░░░░░░░ lot of the justices ░░░░░░░░ that they took into ░░░░░░░░ lot of consideration is ░░░░░░░░ the application programs they ░░░░░░░░ looking at in particular ░░░░░░░░ thought according to chief ░░░░░░░░ today had some stereotypes ░░░░░░░░ certain racial groups such ░░░░░░░░ Asian Americans So perhaps ░░░░░░░░ to some of the ░░░░░░░░ in the early 20th ░░░░░░░░ Jewish Americans faced I ░░░░░░░░ the court felt that ░░░░░░░░ were some stereotypes actually ░░░░░░░░ races and so the ░░░░░░░░ is saying that one ░░░░░░░░ can t be preferenced ░░░░░░░░ beneath another just on ░░░░░░░░ basis The whole person ░░░░░░░░ to be looked at ░░░░░░░░ the court here different ░░░░░░░░ the big blockbuster constitutional ░░░░░░░░ last year and did ░░░░░░░░ squarely overrule precedent It ░░░░░░░░ that even under its ░░░░░░░░ precedents that these university ░░░░░░░░ could not be upheld ░░░░░░░░ perhaps that s why ░░░░░░░░ chief justice today here ░░░░░░░░ writing in a majority ░░░░░░░░ six justices in contrast ░░░░░░░░ the decision on Roe ░░░░░░░░ Wade last year which ░░░░░░░░ only a five justice ░░░░░░░░ joining in the reasoning ░░░░░░░░ Justice Alito s opinion ░░░░░░░░ let me ask you ░░░░░░░░ re probably familiar with ░░░░░░░░ country s attitude towards ░░░░░░░░ action and the fact ░░░░░░░░ the majority of this ░░░░░░░░ wanted to keep affirmative ░░░░░░░░ in place I realize ░░░░░░░░ is not up to ░░░░░░░░ justices to necessarily look ░░░░░░░░ polls when they re ░░░░░░░░ their decisions and analyzing ░░░░░░░░ way they re going ░░░░░░░░ think But should the ░░░░░░░░ Court now expect fairly ░░░░░░░░ a lot of blowback ░░░░░░░░ years in a row ░░░░░░░░ defying the vast majority ░░░░░░░░ Americans in their rulings ░░░░░░░░ even the ruling that ░░░░░░░░ lot of folks adhere ░░░░░░░░ today from about 20 ░░░░░░░░ ago said that hopefully ░░░░░░░░ would be an end ░░░░░░░░ and a point at ░░░░░░░░ we would continue to ░░░░░░░░ and not have to ░░░░░░░░ such a categorical look ░░░░░░░░ consideration to one factor ░░░░░░░░ comparison to others Jennifer ░░░░░░░░ me interrupt you now ░░░░░░░░ agree That was the ░░░░░░░░ of justice sandra day ░░░░░░░░ connor in 2003 that ░░░░░░░░ would happen It was ░░░░░░░░ aspirational not necessarily something ░░░░░░░░ would come to pass ░░░░░░░░ and it has not ░░░░░░░░ when you say that ░░░░░░░░ hope is that s ░░░░░░░░ But law is not ░░░░░░░░ on hope So where ░░░░░░░░ this go Well again ░░░░░░░░ think a really telling ░░░░░░░░ here in this litigation ░░░░░░░░ in court for 10 ░░░░░░░░ One of the original ░░░░░░░░ sadly who worked on ░░░░░░░░ litigation passed away earlier ░░░░░░░░ year from brain cancer ░░░░░░░░ at a fairly early ░░░░░░░░ but I think it ░░░░░░░░ really looking at the ░░░░░░░░ metrics and specifics here ░░░░░░░░ how Asian Americans in ░░░░░░░░ are disfavored here And ░░░░░░░░ the court is saying ░░░░░░░░ can t be a ░░░░░░░░ group on the basis ░░░░░░░░ race in this country ░░░░░░░░ admissions folks are discriminating ░░░░░░░░ So everybody knows that ░░░░░░░░ is to the Harvard ░░░░░░░░ that was not necessarily ░░░░░░░░ in the university of ░░░░░░░░ Carolina case Just to ░░░░░░░░ sure everybody knows with ░░░░░░░░ case we re dealing ░░░░░░░░ the Asian American situation ░░░░░░░░ then the court I ░░░░░░░░ toward the end of ░░░░░░░░ opinion today which addressed ░░░░░░░░ programs said that like ░░░░░░░░ factors surely if an ░░░░░░░░ has been impacted by ░░░░░░░░ which I think would ░░░░░░░░ some circumstances that reverend ░░░░░░░░ was talking about that ░░░░░░░░ can certainly be mentioned ░░░░░░░░ that admissions folks certainly ░░░░░░░░ look at that but ░░░░░░░░ they would at any ░░░░░░░░ factor of somebody s ░░░░░░░░ like socioeconomic status perhaps ░░░░░░░░ of a parent all ░░░░░░░░ these things that caused ░░░░░░░░ hardship and challenges can ░░░░░░░░ looked at tied to ░░░░░░░░ person s whole application ░░░░░░░░ character It is just ░░░░░░░░ looking at one factor ░░░░░░░░ is a constitutional violation ░░░░░░░░ is what the court ░░░░░░░░ opinion today I think ░░░░░░░░ saying I think it ░░░░░░░░ too broad to say ░░░░░░░░ race cannot be considered ░░░░░░░░ think the court is ░░░░░░░░ it can be considered ░░░░░░░░ with all of the ░░░░░░░░ circumstances that might have ░░░░░░░░ somebody s personal background ░░░░░░░░ an
