HALPERIN: “This is a real challenge because, as they learned in the first order, it just takes one federal judge to issue an order and as long as the Supreme Court is tied 4-4 they can be tied up forever in this. And the more he talks, as you said, the more he creates a problem for himself, even if they think that's not the right standard for a judge to use. Two judges are using that standard.”
