NAPOLITANO: "Can foreign persons come into the United States and invoke federal court seeking money damages for harm caused by federal agents? The law in my view is ambiguous but the Fifth Circuit Court of Appeals said no. The Supreme Court decided to take the case. The Civil Rights Act of 1964 protects persons from the unlawful or excessive use of government power. It doesn’t limit those protections to citizens. So I think this Mexican family should have its day in court. But with a 4-4 split in the Supreme Court it is likely that the decision will probably be upheld and they'll be out of luck."
