Fox News’ legal analyst JudgeAndrew Napolitano found himself in a lively discussion Tuesday withJon Stewart on “The Daily Show,” centered on a contentious charge he recently made against Abraham Lincoln.

Napolitano had previously said that slavery in America was “dying a natural death … instead of allowing it to die, or helping it die, or even purchasing the slaves and then freeing them, which would’ve cost a lot less money than the Civil War cost, Lincoln set about on the most murderous war in American history.”

The two men got deep into a discussion about the 16th president of the United States, with Napolitano insisting that Lincoln had not exhausted all non-violent options, to include legislative measures, to end slavery.
