Jeffrey Toobin: Trump Has Absolutely No Authority to Override Governors on Reopening Churches

‘The CDC is giving recommendations; they are of course free to issue recommendations’

EXCERPT:

TOOBIN: "Absolutely not. The President doesn’t have this authority. And the reason Kayleigh McEnany didn’t answer that question is because she couldn’t. The CDC is giving recommendations. They are, of course, free to issue recommendations. But it is up to the states. This is a core state function. It’s like the state has every right to tell a church or a synagogue, you have to have fire alarm in your building, you have to have fire extinguishers. This is something that state governments do. The federal government does not have the ability to override that or change it in any way, because the federal government’s powers are limited under the Constitution and this isn’t one that they have."
