There are a number of different statutes that could potentially govern the selection of a new Attorney General when the sitting Attorney General resigns or is fired, depending on your take on the news here. There are folks who believe that under the Vacancy Reform Act this is, if a poor choice, still a legitimate one while other constitutional scholars believe it’s simply illegal. And what that does in the Department is creates an incredible period of uncertainty because Mr. Whitaker will oversee not just the Mueller investigation but the day-to-day business of the Department. It was a bad choice for all of us and Trump should have seen this coming."
