HEMMER: "Another alert now. Awaiting President Trump to announce his choice to replace retiring Justice Anthony Kennedy. That will happen at 9:00 East Coast time tonight. Some Democrats at the Senate Judiciary Committee already getting ready for tough questioning, they're saying, arguing that anyone he selects would help roll back abortion rights. Judge Andrew Napolitano, FOX News senior judicial analyst here on all this now. How are you doing, sir? Good day to you."
NAPOLITANO: "Good, Bill. Good morning."
HEMMER: "I know, you had a very busy weekend. As you described you are in the crosscurrents of the conversations as to where the president’s head is now. What can you report based on your conversations?"
NAPOLITANO: "I believe that the president has narrowed his choice down to two, to Judge Raymond Kethledge and Judge Thomas Hardiman. Now, I believe that from the crosscurrents, that is the communications that I was involved with by the various groups that are lobbying for or against the four finalists. But one of the deciding factors in the president’s decision -- and look, I could be wrong, we’ll know in 12 hours, was confirmability. And Senator Mitch McConnell, the Republican leader on the Senate said to him, we’ll have issues with Judge Barrett and Judge Kavanaugh that we won’t have with Judge Kethledge and Judge Hardiman."
HEMMER: "Suggesting Republicans would have a problem."
NAPOLITANO: "Yes, Republicans who are concerned about the perception. We don’t know what the reality is, because they are not in the court yet. The perception that these two Judge Kavanaugh and Judge Barrett would be lightening rods on the issue of abortion. I think Senator McConnell is right. They are perceived as lightning rods on abortion, whereas the other two Judge Kethledge and Judge Hardiman are not."
