As an executive order, former President Obama's Deferred Action Childhood Arrivals (DACA), was not actual law, and there was on "shaky legal ground," admitted the senior Democratic senator from California, Dianne Feinstein.

She appeared on MSNBC's "MTP Daily" Tuesday evening. Here's a transcript of the exchange:

TODD: "Was DACA legal?"

FEINSTEIN: "DACA was executive order. Legal is what is the law of passage of something. You know, there are ten attorneys general prepared to sue. I don't want to get into that. The point is, DACA is here. And we've got 800,000 young people --"

TODD: "Your answer indicates, though, it's on shaky legal ground."

FEINSTEIN: "It is. That's why we need to pass a law. And we should do it."
