RUSH TRANSCRIPT For a ░░░░░░░░ now I ve been ░░░░░░░░ the strong belief that ░░░░░░░░ general Merrick Garland just ░░░░░░░░ his career knowing some ░░░░░░░░ that work with him ░░░░░░░░ basically sooner rather die ░░░░░░░░ be the person to ░░░░░░░░ an ex president of ░░░░░░░░ United States the first ░░░░░░░░ So I ve been ░░░░░░░░ under the assumption it ░░░░░░░░ not going to happen ░░░░░░░░ s until last week ░░░░░░░░ we learned that federal ░░░░░░░░ searched the home of ░░░░░░░░ Department of Justice official ░░░░░░░░ Clark a man essential ░░░░░░░░ the plot to use ░░░░░░░░ DoJ to overturn the ░░░░░░░░ Law enforcement officials raided ░░░░░░░░ house just before seven ░░░░░░░░ the morning According to ░░░░░░░░ of his colleagues they ░░░░░░░░ him in the streets ░░░░░░░░ his pajamas and took ░░░░░░░░ electronic devices There are ░░░░░░░░ ways you can execute ░░░░░░░░ warrants but executing a ░░░░░░░░ search that includes putting ░░░░░░░░ former DoJ employee on ░░░░░░░░ scene there pjs Which ░░░░░░░░ happens every day in ░░░░░░░░ but not necessarily to ░░░░░░░░ sorts of folks sort ░░░░░░░░ feels like the Department ░░░░░░░░ Justice is playing hardball ░░░░░░░░ Rangappa is a former ░░░░░░░░ in the FBI counter ░░░░░░░░ division and a lecture ░░░░░░░░ Yale university author and ░░░░░░░░ of the forum just ░░░░░░░░ and Chuck Rosenberg he ░░░░░░░░ a former senior FBI ░░░░░░░░ They both join me ░░░░░░░░ It s great to ░░░░░░░░ you both I know ░░░░░░░░ of you have a ░░░░░░░░ of institutional knowledge and ░░░░░░░░ you are carrying into ░░░░░░░░ discussion So maybe let ░░░░░░░░ first start with the ░░░░░░░░ of things legally as ░░░░░░░░ know from just what ░░░░░░░░ publicly available And the ░░░░░░░░ to which that has ░░░░░░░░ So I will start ░░░░░░░░ you Asha Rangappa The ░░░░░░░░ to which you think ░░░░░░░░ the lines of wet ░░░░░░░░ Litman and others have ░░░░░░░░ have said is new ░░░░░░░░ for facts and the ░░░░░░░░ as we know them ░░░░░░░░ Chris thank you for ░░░░░░░░ me on So I ░░░░░░░░ it s important at ░░░░░░░░ outset to know that ░░░░░░░░ January six community and ░░░░░░░░ Department of Justice even ░░░░░░░░ that they are working ░░░░░░░░ parallel they have different ░░░░░░░░ They want to seek ░░░░░░░░ accountability So they need ░░░░░░░░ see whether criminal law ░░░░░░░░ been violated or whether ░░░░░░░░ is evidence to prove ░░░░░░░░ a reasonable doubt The ░░░░░░░░ six committee is concerned ░░░░░░░░ public accountability They don ░░░░░░░░ have to be concerned ░░░░░░░░ things like invincibility or ░░░░░░░░ evidentiary concerns And they ░░░░░░░░ to work methodically They ░░░░░░░░ go straight to the ░░░░░░░░ So there can be ░░░░░░░░ disconnect between the evidence ░░░░░░░░ we are seeing from ░░░░░░░░ committee which is explosive ░░░░░░░░ people imagine that Garland ░░░░░░░░ be ready to invite ░░░░░░░░ And where the Department ░░░░░░░░ Justice might actually be ░░░░░░░░ their somewhat plotting investigation ░░░░░░░░ totally get the thought ░░░░░░░░ be incredibly frustrating because ░░░░░░░░ top of that they ░░░░░░░░ completely silent So I ░░░░░░░░ the Department of Justice ░░░░░░░░ probably not as far ░░░░░░░░ as what we imagine ░░░░░░░░ would be given the ░░░░░░░░ is coming from the ░░░░░░░░ that is just because ░░░░░░░░ re working on different ░░░░░░░░ and standards That is ░░░░░░░░ really good point Even ░░░░░░░░ the evidentiary questions Like ░░░░░░░░ you can uncounted mitt ░░░░░░░░ what is your feeling ░░░░░░░░ all of this I ░░░░░░░░ tasha s point about ░░░░░░░░ committee doing a top ░░░░░░░░ investigation is important one ░░░░░░░░ perhaps explaining a bit ░░░░░░░░ I was a prosecutor ░░░░░░░░ a long time Chris ░░░░░░░░ were cases from the ░░░░░░░░ up So if you ░░░░░░░░ induce the evidence and ░░░░░░░░ conviction you get people ░░░░░░░░ cooperate You convict and ░░░░░░░░ cooperate You convict and ░░░░░░░░ cooperate And you move ░░░░░░░░ the period It seems ░░░░░░░░ be focused on the ░░░░░░░░ top of the pyramid ░░░░░░░░ so it is a ░░░░░░░░ different orientation Also I ░░░░░░░░ you have to be ░░░░░░░░ careful because let s ░░░░░░░░ the committee has interviewed ░░░░░░░░ people and let s ░░░░░░░░ that they spent four ░░░░░░░░ with each one I ░░░░░░░░ t a math major ░░░░░░░░ 1000 times for his ░░░░░░░░ We have so far ░░░░░░░░ about 10 or 12 ░░░░░░░░ of testimony They may ░░░░░░░░ 4000 hours worth of ░░░░░░░░ So sort of like ░░░░░░░░ reading the first three ░░░░░░░░ of the piece and ░░░░░░░░ writing a book report ░░░░░░░░ saying I ever did ░░░░░░░░ in college but we ░░░░░░░░ t yet know a ░░░░░░░░ of what the committee ░░░░░░░░ We know almost nothing ░░░░░░░░ the Department of Justice ░░░░░░░░ So I think asha ░░░░░░░░ caution to be mindful ░░░░░░░░ those different paradigms is ░░░░░░░░ important Let s talk ░░░░░░░░ the development on eastman ░░░░░░░░ Clark Because that seems ░░░░░░░░ me quite significant Anytime ░░░░░░░░ and sub searched by ░░░░░░░░ feds whether it is ░░░░░░░░ elected official back when ░░░░░░░░ was in Chicago covering ░░░░░░░░ politics it happened every ░░░░░░░░ week with you know ░░░░░░░░ means that there is ░░░░░░░░ there It is not ░░░░░░░░ from square one What ░░░░░░░░ your judgment again from ░░░░░░░░ we know publicly about ░░░░░░░░ significance of the eastman ░░░░░░░░ Clark searches Yes Chris ░░░░░░░░ would say there is ░░░░░░░░ news and there is ░░░░░░░░ news I think the ░░░░░░░░ news is that they ░░░░░░░░ have people who are ░░░░░░░░ of the major players ░░░░░░░░ architects of this coup ░░░░░░░░ their sights Specifically Jeffrey ░░░░░░░░ who was ready to ░░░░░░░░ the Justice Department and ░░░░░░░░ a part of executing ░░░░░░░░ fraudulent scheme The inconclusive ░░░░░░░░ is that the investigation ░░░░░░░░ coming out of the ░░░░░░░░ of the inspector general ░░░░░░░░ is the internal watchdog ░░░░░░░░ the Justice Department and ░░░░░░░░ Clark is an employee ░░░░░░░░ investigated him and it ░░░░░░░░ like again the good ░░░░░░░░ that he has turned ░░░░░░░░ a criminal investigation and ░░░░░░░░ the eastman search warrant ░░░░░░░░ to be connected to ░░░░░░░░ I would be interested ░░░░░░░░ know what Chuck thinks ░░░░░░░░ this I don t ░░░░░░░░ that you can come ░░░░░░░░ a lot of conclusions ░░░░░░░░ it kind of they ░░░░░░░░ a head start on ░░░░░░░░ piece of the investigation ░░░░░░░░ that means in terms ░░░░░░░░ where they are for ░░░░░░░░ other players I don ░░░░░░░░ know that we necessarily ░░░░░░░░ how far along they ░░░░░░░░ for Roger Stone for ░░░░░░░░ or Rudy Giuliani or ░░░░░░░░ Donald Trump though I ░░░░░░░░ that they will all ░░░░░░░░ at some point What ░░░░░░░░ you think Chuck I ░░░░░░░░ not trying to leave ░░░░░░░░ wiggle room with this ░░░░░░░░ Chris But I will ░░░░░░░░ you You re a ░░░░░░░░ it s okay I ░░░░░░░░ a prosecutor big difference ░░░░░░░░ me tell you what ░░░░░░░░ know and what I ░░░░░░░░ t know With a ░░░░░░░░ warrant that means that ░░░░░░░░ to a federal judge ░░░░░░░░ asked her to review ░░░░░░░░ sign a warrant Which ░░░░░░░░ test of the fact ░░░░░░░░ they have probable cause ░░░░░░░░ believe that a crime ░░░░░░░░ been committed and that ░░░░░░░░ are going to find ░░░░░░░░ of that crime in ░░░░░░░░ place that they are ░░░░░░░░ to search So Mr ░░░░░░░░ s house or Mr ░░░░░░░░ s phone That is ░░░░░░░░ a good thing if ░░░░░░░░ are Clark or eastman ░░░░░░░░ is never a good ░░░░░░░░ Chris to have the ░░░░░░░░ or somebody else knock ░░░░░░░░ your door and take ░░░░░░░░ stuff Now the wiggle ░░░░░░░░ part of it It ░░░░░░░░ t mean they will ░░░░░░░░ charged with a crime ░░░░░░░░ people who are searched ░░░░░░░░ search warrants are ultimately ░░░░░░░░ with a crime But ░░░░░░░░ doesn t mean that ░░░░░░░░ so as asha had ░░░░░░░░ earlier we need to ░░░░░░░░ patient Patience is hard ░░░░░░░░ only know a tiny ░░░░░░░░ of what the Department ░░░░░░░░ Justice is doing right ░░░░░░░░ But there is a ░░░░░░░░ clear delineation about what ░░░░░░░░ were doing all the ░░░░░░░░ 800 cases were tied ░░░░░░░░ violence and what we ░░░░░░░░ them doing now where ░░░░░░░░ are moving to the ░░░░░░░░ vote fraud It is ░░░░░░░░ important delineation I think ░░░░░░░░ step is really where ░░░░░░░░ start to get much ░░░░░░░░ to the president They ░░░░░░░░ up a whole bunch ░░░░░░░░ really profound to me ░░░░░░░░ questions kind of democratic ░░░░░░░░ questions about how does ░░░░░░░░ self governing rule of ░░░░░░░░ country go about this ░░░░░░░░ of thing Other countries ░░░░░░░░ done it of course ░░░░░░░░ fact I would love ░░░░░░░░ continue that conversation as ░░░░░░░░ goes forward in the ░░░░░░░░ with both of you ░░░░░░░░ Rangappa and Chuck Rosenberg ░░░░░░░░ was very enlightening thank ░░░░░░░░ both When we come ░░░░░░░░ how the
